החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת ערבון בהליך שבכותרת.

ההליך נסוב על החלטתו של בית המשפט המחוזי בתל-אביב-יפו (מיום 7.2.2008) אשר הורה על מתן צו לכינוס נכסי המערערת, במסגרת הליכי פשיטת רגל בהם נקטו משיבים 1 ו-2 נגד המערערת. ההחלטה התבססה על כך שנגד המערערת עומדים שני פסקי דין חלוטים והליכי הוצאה לפועל אשר החלו על בסיסם; התראת פשיטת רגל הומצאה למערערת והתנגדות המערערת נדחתה. על כך הוסיף בית המשפט את העובדה שהמערערת עצמה הצהירה בהליכים קודמים שהיא חדלת פרעון. בהחלטתו חייב בית המשפט את המערערת בהוצאות המשיבים בסך 20,000 ₪, נוכח התנהלותה החריגה והתמשכות ההליכים בשל זאת.

בבקשה לפניי נטען כי מצבה הכלכלי של המערערת בכי רע. לטענתה, היא מתקיימת מקצבאות ביטוח לאומי העומדות על כ-2,000 ₪. על פי האמור בבקשה, למערערת זכות חכירה בדירה בבאר שבע אולם זו משועבדת לחברת הביטוח כלל. מאחר שהמערערת אינה עומדת בתשלומי המשכנתא, מונה כונס נכסים לדירה. דמי השכירות מן הדירה מועברים, לדבריה, ישירות לידי בעלת המשכנתא. המערערת מוסיפה וטוענת כי נפתחו נגדה שני תיקי הוצאה לפועל ובאחד מהם נקבע, לאחר חקירת יכולת, כי עליה לשלם 500 ₪ בחודש. משיבים 1 ו-2 מתנגדים לבקשה. משיב 3 לא הגיב לבקשה.

על בעל דין המבקש פטור מתשלום אגרה ומהפקדת ערבון מוטל הנטל לפרוש לפני בית המשפט תשתית עובדתית מלאה ועדכנית בדבר מצבו הכלכלי. נטל זה גובר שעה שמבקש הפטור לא שילם את ההוצאות בהן חויב בבית המשפט קמא, כפי שלטענת משיבים 1 ו-2 אירע במקרה דנן. המערערת לא עמדה בנטל זה במלואו. אמנם, מן הבקשה, התצהיר והתיעוד שצורף נראה כי מצבה הכלכלי של המערערת אינו מן המשופרים. עם זאת, המערערת לא פרשה תמונה מלאה בדבר יכולתה הכלכלית, משלא הבהירה מדוע אין באפשרותה להסתייע בקרוביה, לשם מימון עלויות ההליך המשפטי. בפרט לא הובהר מדוע המערערת אינה יכולה להסתייע באחותה, לטובתה היא הסתלקה מירושת אחיה, אשר כוללת כמה נכסי מקרקעין. בנוסף, לא הובהר בבקשה כיצד ממומן ייצוגה המשפטי של המערערת. אוסיף, כי עיון בהחלטת בית המשפט ובהודעת הערעור מעלה כי על פני הדברים, סיכויי ההליך אינם טובים במידה המצדיקה פטור מערבון. נוכח האמור, אין בידי לקבל את הבקשה לפטור מאגרה וערבון. יחד עם זאת, בשים לב לתשתית החלקית שהוצגה, יופחת סכום האגרה לסך של 1,500 ₪. אשר לערבון, נוכח מהות ההליך והיקפו, התשתית החלקית שהוצגה, סכום ההוצאות שנפסקו בבית המשפט קמא וההוצאות הצפויות אם ייכשל ההליך, יועמד הערבון על סך של 10,000 ₪. האגרה תשולם והערבון יופקד תוך 21 יום מעת המצאת החלטה זו, ולא – יימחק ההליך או יידחה, בהתאמה, ללא צורך במתן הודעה נוספת.
