החלטה
בתיק שבכותרת ניתן ביום 7.11.2010 פסק-דין, המורה על מחיקת ההליך ללא צו להוצאות, וזאת לבקשת בעלי הדין.
בתחילת שנת 2011 פנתה המערערת 2 בבקשה לביטול פסק הדין ולחידוש ההליך בעניינה, זאת בטענה כי בעלה – המערער 1 – הסכים למחיקת הערעור בלי ליידע אותה על כך. בקשה זו הובאה לפני כבוד הרשמת ד' כהן-לקח (שנתנה את פסק הדין), וביום 1.5.2011 קבעה כבוד הרשמת כי ההליך בעניינה של המערערת 2 יחודש, ובלבד שזו תשלם הוצאות לטובת המשיב בסך של 3,000 ₪. ודוק: בהחלטה הובהר כי תנאי לחידוש ההליך בעניינה של המערערת 2 הוא הצגת אישור בדבר תשלום ההוצאות למשיב, זאת בתוך 10 ימים. ביום 21.8.2011 ניתנה החלטה נוספת של כבוד הרשמת, שלפיה ההליך בעניינה של המערערת 2 לא יחודש , משום שלא הוצג אישור בדבר תשלום ההוצאות למשיב.
כעת, קרוב לשלוש שנים מאז שניתנו ההחלטות האמורות על-ידי כבוד הרשמת כהן-לקח, הגישה המערערת 2 "בקשה דחופה להארכת מועד להפקדת עירבון". אומר מיד, כי לא ברור מדוע מתייחסת המערערת 2 להפקדת עירבון, שעה שמהות הבקשה היא מן הסתם תשלום ההוצאות שנפסקו בהחלטת כבוד הרשמת מיום 1.5.2011 כתנאי לחידוש ההליך (ולמעשה – ביטול ההחלטה מיום 21.8.2011, שבה קבעה כבוד הרשמת כי פסק הדין בדבר מחיקת ההליך עומד על-כנו). מכל מקום, טענתה העיקרית של המערערת 2 היא כי עד לפני חודשיים לא הייתה מודעת להחלטת כבוד הרשמת מיום 1.5.2011.
דין הבקשה להידחות.
ראשית אציין, כי בהתאם להוראת כבוד הרשמת כהן-לקח למזכירות בית המשפט, ההחלטה מיום 1.5.2011 הומצאה לכתובת שמסרה המערערת 2 במסגרת בקשתה לחידוש ההליך, ולא הוכח פגם בהמצאה. אולם מעבר לכך, ברי כי אם לא ביררה המערערת 2 באשר לגורל בקשתה לחידוש ההליך – בקשה שכאמור הוגשה בתחילת שנת 2011 – וישבה בחיבוק ידיים במשך תקופה כה ממושכת, הרי שמדובר בחוסר מעש מובהק העולה כדי זניחת ההליך.
במצב דברים זה, לא מצאתי כל עילה לביטול החלטת כבוד הרשמת כהן-לקח מיום 21.8.2011 ולחידוש ההליך שהסתיים בשנת 2011.
