בקשה לעיין בתיק בית המשפט
החלטה
הבקשה שלפניי, שהינה בקשה לעיון בתיק הערעור שבכותרת, הועברה לטיפולי בשל חילופי גברי בלשכת הרשמים. עניינו של הערעור בפיצויים בגין הפקעה משנת 1954 של מקרקעין מסוימים באזור בו שוכן כיום קיבוץ המעפיל. בבקשת העיון צוין, כי החברה אשר הגישה את הבקשה עוסקת באיתור נכסים אשר היו בבעלות נספי שואה, וכי באזור שבו מצויים המקרקעין נשוא הליך זה ישנה סבירות לקיומן של קרקעות שכאלה. המערערת הביעה את הסכמתה לעיון, ואילו המשיבים התנגדו לו.
המסגרת הנורמטיבית לבחינת בקשה לעיון בתיק בית משפט של מי שאינו בעל דין, מצויה בתקנה 4 לתקנות בתי המשפט ובתי הדין לעבודה (עיון בתיקים), התשס"ג-2003 (להלן: תקנות העיון ). כידוע, ככלל - ובהיעדר איסור שבדין - נקודת המוצא הינה כי יש להיעתר לבקשת העיון, וזאת על רקע ההכרה במעמדו של עיקרון פומביות הדיון. ככל שאחד מבעלי הדין מתנגד לעיון, הרי שעליו מוטל הנטל לשכנע בקיומו של טעם ממשי המצדיק את שלילתו (ראו למשל, ע"א 8849/01 סבוב נ' פקיד שומה למפעלים גדולים , פ"ד נט(5) 385 (2005); בג"ץ 5917/97 האגודה לזכויות האזרח בישראל נ' שר המשפטים
(8.10.2009), פסקאות 25-24). אכן, עוד טרם כניסתן של תקנות העיון לתוקף נפסק כי "הכלל הוא אפוא שיש לאפשר עיון במסמכים המצויים בתיקי בית - המשפט, ואף את פרסומם, אלא אם קיימים הוראה תחיקתית או טעם כבד משקל הנגזר ממנה המצדיקים, באיזון כולל, את מניעת העיון או הפרסום" (ע"א 4825/97 גהל נ' פקיד שומה למפעלים גדולים , פ"ד נה(2) 433 (2000); וראו גם: בג"ץ 9474/00 גל נ' ראש עיריית חיפה , פ"ד נט(3) 714 (2004), ובג"ץ 10076/02 רוזנבאום נ' נציב שירות בתי הסוהר (22.8.2005)).
ומהכלל אל ענייננו: ההליך שבכותרת התנהל בדלתיים פתוחות, ולא נטען כי קיים איסור בדין לעיון המבוקש. מתגובת המשיבים עולה כי סבורים הם שאין די בפירוט אשר נכלל בבקשת העיון. ואולם, הכלל בעניין זה הינו כי נטל ההנמקה המוטל על מבקש העיון הינו קל, ודי בהנמקה קצרה ותמציתית (עניין האגודה לזכויות האזרח
לעיל, פיסקה 25). דווקא התנגדותם של המשיבים הובעה באופן לקוני וסתמי, מבלי שניתן טעם מהותי להתנגדות ומבלי שהוסבר כיצד עלולים הם להיפגע מן העיון המבוקש. בנסיבות אלו, רואה אני להיעתר לבקשת העיון.
אשר על כן, ניתן בזאת היתר למבקשת העיון לעיין בתיק בית המשפט בהליך שבכותרת. העיון יבוצע במזכירות בית המשפט בהתאם לנוהל המקובל.
