בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון. הבקשה הוגשה במסגרת ערעור על פסק-דין של בית המשפט לעניינים מנהליים בתל-אביב-יפו, שדחה את עתירתם של המערערים בעניין היתר בנייה שניתן לבקשת המשיבה 3 (ההיתר מתייחס לפיתוח טיילת חוף בעיר הרצלייה). המערערים הם "מפלגת הירוקים" ומר דרור עזרה שהוא רכז תחום ים וחופים במפלגה. לדברי המערערים, מצבה הכלכלי של המפלגה קשה והיא מצויה בגירעון; המפלגה פועלת למען הסביבה וההליך שבנדון הוא חלק מפעילות ציבורית זו; והמגמה בפסיקה היא להימנע מחיוב גופים ציבוריים בהוצאות שידכאו את פעילותם במישור המשפטי. המערערים מציינים גם כי בא-כוחם מעניק להם שירות משפטי ללא תשלום.
לאחר שעיינתי בטענות המערערים ובתגובות המשיבים, לא מצאתי לנכון לפטור את המערערים מהפקדת עירבון, אם כי ראיתי לנכון להפחית את הסכום שנקבע על-ידי המזכירה הראשית (30,000 ₪).
כלל הוא, כי "החובה להפקיד עירבון חלה גם בהליכים בעלי אופי ציבורי וגם כאשר יוזם ההליך הינו עותר ציבורי, ובכלל זה עמותות, ארגונים וועדי פעולה הפועלים למטרות ציבוריות" (בר"ם 10956/08 סיאם נ' עיריית ירושלים (לא פורסם, 29.1.2009)). עם זאת, כאשר מדובר בהליכים בעלי משמעות חברתית או ציבורית כללית, יש לכך השלכה אפשרית על שיעור העירבון. הדבר נובע, בין היתר, מהגישה המאופקת יחסית בכל הנוגע להטלת הוצאות בהליכים המעלים סוגיה ציבורית חשובה, כשלעניין זה מובאים בחשבון מעמדו של יוזם ההליך, חשיבות האינטרס הציבורי שמבקש הוא לקדם, והיעדר עניין אישי בהליך (ראו ע"א 9535/04 סיעת "ביאליק 10" נ' סיעת "יש עתיד לביאליק" (טרם פורסם, 16.6.2005)); עוד יש חשיבות לרצון להימנע מהכבדת יתר על עותרים ציבוריים – הכבדה שעלולה להיות מתורגמת להרתעת יתר ולהדרת רגליהם מנקיטת הליכים (ראו עע"מ 3307/04 קול אחר בגליל נ' המועצה האזורית משגב (לא פורסם, 10.5.2004); דנג"ץ 9865/06 ח"כ אילטוב נ' הוועדה המחוזית לתכנון ולבניה (לא פורסם, 11.2.2007)).
בענייננו, הטענה בדבר מצבה הכלכלי הקשה של המערערת 2 לא בוססה כדבעי, והאסמכתא היחידה שצורפה לבקשה היא מסמך לא עדכני של רואה-חשבון (המסמך מתאריך 13.10.2009). יצוין כי לבקשה אף לא צורף תצהיר לתמיכה בטענות המועלות בה. אשר למערער 1, הטענה כי הלה פועל "מטעם המבקשת ועל דעתה" אין בה כשלעצמה כדי לפטור אותו מן החובה להראות כי מצבו הכלכלי אינו מאפשר לו – כאחד מיוזמי ההליך הערעורי (וההליכים שקדמו לו) – לשאת בנטל העירבון. אולם הבקשה אינה מתייחסת כלל למערער 1. זאת ועוד, בית המשפט המחוזי חייב את המערערים לשלם את הוצאות המשיבים ושכר-טרחת עורך-דינם, בסכום של 30,000 ₪ למשיבות 2 ו-3 ובסכום זהה למשיבה 1. בכך יש כדי להקשות על אימוץ הנחה כי גם אם יידחה הערעור לא יוטלו הוצאות או שיוטלו הוצאות בשיעור נמוך ביותר. יתרה מכך, לדברי המשיבות ההוצאות שנפסקו לזכותן בבית המשפט המחוזי טרם נפרעו, ובכך יש כדי להבליט את חשיבות ההגנה על אינטרס המשיבות בקיום מקור זמין ונוח לגביית הוצאות שייפסקו לזכותן בערכאה זו, אם ייפסקו.
בהתחשב בכל אלה, וכן במספר המשיבים ובמכלול טענות הצדדים, ומבלי שראיתי צורך להרחיב את הדיבור באשר לסיכויי ההליך, באתי למסקנה כי יש להעמיד את סכום העירבון בהליך זה על 20,000 ₪. המערערים יפקידו את העירבון תוך 21 ימים מעת המצאת החלטה זו (ימי הפגרה יבואו במניין), שאם לא כן – יירשם ההליך לדחייה ללא צורך במתן הודעה נוספת.
