בקשה להפחתת סכום העירבון

המבקש עותר להפחתת סכום העירבון אשר נקבע על ידי המזכירה הראשית (סך של 20,000 ש"ח).
בפי המבקש אין כל טענה לחוסר יכולת כלכלית, וסבורני כי בנימוקים שהעלה, אשר עיקרם מהות ההליך וחשיבותו הנטענת, אין כדי להצדיק את הפחתת העירבון באופן מהותי ולהעמידו על סכום זניח. כן לא ניתן לקבל את טענת המבקש לפיה בית המשפט קמא "לא היווה ערכאה ראשונה של ממש".
עם זאת בנסיבות העניין ובשים לב למהות ההליך מצאתי להפחית את סכום העירבון במידה מסוימת, ולהעמידו על סך של 15,000 ש"ח.
עירבון בשיעור האמור יופקד בתוך 14 ימים ממועד המצאת ההחלטה, ולא - יירשם ההליך לדחיה, ללא הודעה נוספת.
