בקשה למתן ערובה
החלטה
בהליך שבכותרת נקבע עירבון בסך 15,000 ₪. לפניי בקשת המבקשת להסתפק כחלופת עירבון בהתחייבות עצמית מטעם הראל חברה לביטוח בע"מ, המבטחת את המבקשת בפוליסה לביטוח נושאי משרה מכוחה היא מיוצגת בבקשת רשות הערעור. המשיבה 2 מסכימה לבקשה. המשיבה 1 סבורה כי מן הראוי שהעירבון יופקד במזומן או באמצעות ערבות בנקאית.
דין הבקשה להתקבל. כבר נקבע בפסיקתו של בית-משפט זה כי האיתנות הפיננסית וכיבוד פסיקת הוצאות על-ידי חברות ביטוח, מאפשרים לראות בהתחייבות עצמית מטעמן כשוות-ערך להפקדת עירבון במזומן או באמצעות ערבות בנקאית (ראו למשל: בש"א 5385/09 עיריית חיפה נ' עמותת העדה היהודית הספרדית בחיפה (לא פורסם, 16.7.2009)). בהתחשב בכך שמטרת העירבון – הבטחת הוצאות המשיבות – תובטח באמצעות ההתחייבות העצמית המבוקשת, ובהתחשב בכך שהמשיבה 1 לא הציגה טעם ממשי להתנגדותה, אני סבורה כי ניתן להיעתר לבקשה. המבקשת תגיש תוך 5 ימים מעת המצאת החלטה זו התחייבות עצמית מקורית בלתי מותנית מטעם הראל חברה לביטוח בע"מ לתשלום הוצאות משפט - אם ייפסקו - בסך 15,000 ₪ לטובת שתי המשיבות בהליך שבכותרת. החלטה זו תומצא לצדדים באמצעות הפקסימיליה.
