בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון. הבקשה הוגשה במסגרת ערעור על החלטה של בית המשפט המחוזי בתל-אביב-יפו, בשבתו כבית משפט של פשיטת רגל (החייב הוא המשיב 1). בהחלטתו דחה בית המשפט קמא את בקשתם של שניים מנושיו של החייב – בהם המערער – לביטול החלטתם של הנאמנים לאשר באופן חלקי את תביעתו של נושא אחֵר, הוא המשיב 5.
קראתי בעיון את בקשתו של המערער. מכיוון שהמערער מיוצג על-ידי הלשכה לסיוע משפטי – עובדה המקנה לו פטור מתשלום אגרה – ניתן להניח כי מצבו הכלכלי אינו מן המשופרים. עם זאת, כבר נקבע לא אחת כי ייצוג מטעם הלשכה לסיוע משפטי אינו מקנה פטור מניה וביה מהפקדת עירבון. כדי לזכות בפטור זה יש להניח תשתית עובדתית וראייתית הולמת, ובכלל זה להתייחס כראוי לנושא האפשרות להסתייע בסביבה הקרובה. להתייחס כראוי, משמע: להציג פירוט הולם בעניין זה, וכן מסמכים תומכים. עמד על כך כבוד השופט ס' ג'ובראן, בציינו כי מבקש הפטור:
[נדרש] להוכיח כי לא רק הוא עצמו, לרבות בת זוגו והוריו אם הוא סמוך על שולחנם (ראו תקנה 14 (א) לתקנות האגרות), נעדר יכולת כלכלית, אלא שאף לא עלה בידו להסתייע בסביבתו הקרובה על מנת לגייס את הסכום להפקדה. תכלית המבחן היא להרחיב את הנטל המוטל על יוזם ההליך להבטחת האינטרס של הצד שכנגד, אשר שלא מיוזמתו, נאלץ לשאת בהוצאות של הליך משפטי נוסף. אין מדובר במבחן נוקשה, אלא בכלי נוסף העומד לרשות הרשם בבואו לאזן בין השיקולים המתחרים במסגרת בקשה למתן פטור מהפקדת עירבון: זכותו של מבקש הפטור שלא תיחסם דרכו רק משום שהוא דל באמצעים אל מול ההפסד שעלול להיגרם לצד השני, אם לא יהיה לו ממה לגבות את הוצאותיו (בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב (טרם פורסם, 3.10.2011)).
בענייננו, המערער אמנם טוען כי אין מי שיכול לסייע לו, אולם טענה זו אינה נתמכת בפירוט ובתיעוד מניחים את הדעת. בהקשר זה יצוין כי מן הבקשה עצמה עולה כי למבקש בנות בגירות, בעלות משפחות, ולא מצאתי התייחסות מספקת באשר למצבן הכלכלי ובאשר לנכונותן לסייע בגיוס כספי העירבון. לעניין זה יפים דבריו של כבוד השופט הנדל באחת הפרשות (בש"א 9998/09 ונדר נ' בנק דיסקונט למשכנתאות בע"מ (טרם פורסם, 17.12.2009)):
הלכה פסוקה היא כי הפנייה לקופת בית המשפט תיעשה כמוצא אחרון ורק לאחר ששוכנע בית המשפט כי מוצו ניסיונותיו הכנים של מבקש הפטור לגייס את סכום העירבון מהמעגל הקרוב אליו... לא די בהעלאת הטענה כי קרוב משפחה מדרגה ראשונה אינו יכול לעזור למבקש פטור מעירבון. יש לגבות זאת בנתונים ובמסמכים המאמתים את היעדר יכולתו או היעדר מוכנותו.
עוד יצוין כי לדברי המערער הוא צפוי לקבל "בעתיד הלא רחוק" ירושה בסכום גדול ביותר. המערער אינו מציג כל פירוט בעניין זה, ויותר מכך: אם אמנם יש למערער קרוב בעל יכולת כלכלית משמעותית – כעולה מן הטענה האמורה – הרי אין בכך אלא כדי להבליט את החסר בכל הנוגע ליכולת ליטול הלוואה או להסתייע באחרים כדי להעמיד עירבון בהליך זה (יצוין כי מטענות הצדדים עולה שהמערער העמיד עירבון בהליך שניהל בעבר). הוסיפו לכך את העובדה שאין בבקשה התייחסות הולמת אף לנתונים רלוונטיים נוספים, כגון שיעור ההוצאות השוטפות; ואת טענתם של המשיבים כי המערער נמנע מתשלום הוצאות שהושתו עליו בעבר – ולא פעם אחת – והמסקנה המתקבלת היא שאין הצדקה לויתור על דרישת העירבון בהליך זה.
בשים לב לכלל השיקולים שצוינו, ובהביאי בחשבון את הטענות לגבי המצב הכלכלי אך גם את האינטרס הלגיטימי של המשיבים בקיום מקור (ולוּ חלקי) לגביית הוצאות, מצאתי לנכון להפחית את סכום העירבון ולהעמידו על סך של 7,000 ₪. העירבון יופקד תוף 21 ימים מיום המצאת החלטה זו, שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת.
