בקשה לחילופי בעלי-דין
החלטה
בהחלטתה מיום 6.2.2014 הורתה כבוד הרשמת בנמלך על צירופה של הגב' שולביץ כמשיבה (תוך שציינה כי לא מדובר בבקשה לחילופי בעל דין אלא לצירוף משיב נוסף, ותוך שהבהירה כי אינה נזקקת לטענות מכאן ומכאן לגבי קיומה של עילה נגד המשיבה 1). לאחר מכן, ביום 20.5.2014, התקיים דיון מקדמי לפני כבוד השופט עמית, ובעקבות הדיון ניתנה החלטה בדבר מתווה לסיום ההליך. בהחלטה נוספת, מיום 6.8.2014, הורה כבוד השופט עמית על קיומו של קדם ערעור נוסף (ביום 5.11.2014), ולאחרונה קבע כי מועדי הגשת הסיכומים נדחים "בתקווה שהצדדים ישכילו לחסוך העלויות ותשומות הזמן הכרוכות בהגשת הסיכומים".
לפניי בקשה מיום 3.9.2014, שבה עותרים המערערים לקבוע כי המשיבה 2 היא חליפתה של המשיבה 1 לגבי הטענות והסעדים "בקשר עם הזכויות לפי חוזה החצר הנובעות מן הזכויות בדירה העליונה", וכי המשיבה 1 עודנה משיבה לגבי הטענות והסעדים "בקשר עם העברת הזכויות בדירה בקומת הקרקע".
אין בידי להיעתר לבקשה. כאמור, בשלב הנוכחי המשיבה 2 צורפה להליך כמשיבה נוספת – ראו החלטת כבוד הרשמת בנמלך שהוזכרה לעיל – ואיני רואה בסיס מבורר לשנות כעת את מצב הדברים באופן המבוקש על-ידי המערערים. גם הנימוק המוצג בבקשה – כי הדבר נועד "לשם קידום המאמצים להגיע להסכם כולל בין הצדדים קודם למועד הדיון המקדמי הנוסף" – אינו מוסבר ואינו מפורט, ובוודאי לא זה הזמן להכריע במחלוקות בין הצדדים לגופו של עניין, כפי שציינה גם כבוד הרשמת בנמלך בהחלטה.
המערערים מבקשים לחלופין להורות על הגשת כתב ערעור מתוקן בעקבות צירוף המשיבה 2, ולקבוע כי הערעור המתוקן יוגש עובר להגשת סיכומי הצדדים. אומר מיד כי גם בקשה זו – שהוגשה זמן רב לאחר החלטתה של כבוד הרשמת בנמלך – אינה מנומקת כראוי, ומעבר לכך אזכיר כי מצויים אנו כעת לפני קדם ערעור שני וכי בינתיים הורה כבוד השופט עמית על דחיית מועד הגשת הסיכומים. בנסיבות אלה, איני רואה בשלב זה להורות על הגשת כתבי טענות נוספות וחדשים, ואם העניין יהיה רלוונטי בעתיד, יוכלו המערערים להגיש בקשה מנומקת שתידון כמקובל.
סיכומו של דבר, בשלב הנוכחי איני נעתר לבקשה, וכמובן הצדדים רשאים להעלות טענותיהם לפני כבוד השופט עמית בכפוף להוראותיו.
