בקשה לפטור מעירבון
החלטה
בקשת רשות הערעור שבכותרת נסבה על החלטה של בית המשפט המחוזי בתל-אביב-יפו, שבה נדחתה בקשת רשות ערעור שהגישו המבקשים על החלטה של בית משפט השלום בתל-אביב, אשר דחה בקשת רשות ערעור על החלטת רשמת ההוצאה לפועל, שלא לבטל החלטה קודמת שניתנה על-ידה (ביום 7.5.2013). במסגרת ההליך שבכותרת הוגשה בקשה לפטור מהפקדת עירבון, ולחילופין – להפחתת סכום העירבון ולהמרתו בערבות צד ג. הבקשה באה כעת לטיפולי (על רקע חילופי גברי בלשכת הרשמים).
אין בידי להיעתר לבקשה, למעט הפחתה מסוימת של סכום העירבון (העומד על 25,000 ₪).
כבר בפתח הדברים אציין כי בהליך אחֵר שיזמו (ע"א 7730/10) הגישו המבקשים בקשה דומה, וזו נדחתה בהחלטתי מיום 15.12.2010. בפועל, לאחר אותה החלטה הפקידו המבקשים את העירבון, זאת אף שטענו במסגרת בקשת הפטור – כפי שהם טוענים כעת – כי מיצו את אפשרויות הסיוע. יודגש: לא נעלמה מעיני טענתם של המבקשים כי ההליכים המשפטיים הרבים שהתקיימו עד כה היו כרוכים בהוצאות רבות ובנטילת הלוואות, אולם העובדה היא שהמבקשים מצאו מקורות למימון ההליכים השונים, כמו-גם למימון שכר טרחתו של עורך-דינם ("למעלה ממאה אלף ₪"), ואין בידי לקבוע כי אינם יכולים לגייס סכום כסף גם בהליך הנוכחי. לא מיותר לציין, כי בהחלטתי הנ"ל מיום 15.12.2010 עמדתי על כך שלפי הפסיקה, טענה בדבר חוסר אפשרות להסתייע בסביבה הקרובה צריכה להיות מגובה בנתונים ובמסמכים. דא עקא, שגם לבקשה שלפניי לא צורפו מסמכים לצורך תמיכה בטענה האמורה, ובכלל הבקשה אינה כוללת תיעוד מלא באשר למצב הכלכלי. עוד יודגש, כי המבקשים מציעים חלופה בדמות ערבות צד ג, אולם זהותו של אותו צד ג ופרטיו לא צוינו, ואין נימוק מבורר מדוע הלה לא יסייע בהפקדת עירבון במזומן או בערבות בנקאית.
מעבר לאמור ראוי לציין, בלי לקבוע מסמרות, כי מדובר בהליך ב"גלגול רביעי", כך שהמשֹוכה הניצבת לפני המבקשים היא גבוהה, וסבורני כי אם חפצים הם לגרור את המשיב להליך לפני ערכאה נוספת, הרי שעליהם להפקיד עירבון אשר יהווה מקור זמין ונוח לגביית הוצאותיו, ככל שתפסקנה. הדברים מקבלים משנה תוקף נוכח טענתו של המשיב כי הוצאות שנפסקו לטובתו בעבר לא שולמו, למעט בהליכים שבהם הופקד עירבון.
אשר על כן, אין בידי לפטור את המבקשים מהפקדת עירבון או להמיר את העירבון בערבות צד ג. עם זאת, ראיתי לנכון להפחית במידה מסוימת את סכום העירבון, זאת בשים לב למכלול השיקולים הרלוונטיים לרבות קביעת הערכאות הקודמות בעניין ההוצאות, מהות ההליך ומעמדם של הצדדים. העירבון יעמוד אפוא על סך של 15,000 ₪. סכום זה יופקד תוך 21 ימים מעת המצאת החלטה זו (ימי הפגרה יבואו במניין), שאם לא כן יירשם ההליך לדחייה.
