בקשה לפטור מאגרה ועירבון
החלטה
לפניי בקשה לפטור מתשלום אגרה ומהפקדת עירבון בהליך שבכותרת.
1.ההליך נסב על פסק דינו של בית משפט מחוזי מרכז לפיו נדחה ערעור המבקש על החלטתה של ועדת הערעורים לפי חוק הנכים (תגמולים ושיקום) [נוסח משולב], התשי"ט-1959. המבקש טוען לפניי כי מצבו הכלכלי קשה וכי במסגרת ערעורו לבית המשפט המחוזי היה פטור מתשלום אגרה בהיות ההליך נוגע לזכויות נכי צה"ל. נטען כי לצורך הפקדת עירבון בבית המשפט המחוזי נדרש המבקש ליטול הלוואה ואין לו אפשרות ליטול הלוואה נוספת. לטענת המבקש הוא אינו מצליח למצוא עבודה ממשית והוא עושה מאמצים להחזיק מעמד בעבודתו כנהג. לאחרונה נישא המבקש ולדבריו הפקיד בחשבונו סכומי כסף שקיבל במתנה מאורחיו, אך סכומים אלה מיועדים לתשלום יתרת הוצאות החתונה. לדבריו, הוא ורעייתו מתגוררים בבית הוריו. למעט רכב משנת 1999 אין בידי המבקש נכסים. על פי הנטען, המבקש משלם לבא כוחו את שכר טרחתו בהתאם לסיכויי ההצלחה בערעור. המשיב לא הביע התנגדות לפטרו מאגרה. אשר לעירבון, המשיב סבור כי אין הצדקה לפטור באופן מלא מהפקדת עירבון, נוכח הנתונים בדפי החשבון.
3.מבלי להכריע בשאלה האם קיימת חובה לשלם אגרה בהליך מן הסוג הנדון, באין התנגדות מצד המשיבה, ניתן בזה פטור מתשלום אגרה, כמבוקש.

אשר לבקשה לפטור מהפקדת עירבון, מדפי חשבון הבנק שהציג המבקש עולה כי בחשבונו יתרת זכות משמעותית, העולה על גובה העירבון המקובל בהליכים מן הסוג הנדון. המבקש לא הניח תשתית לטענה כי הכספים מיועדים לתשלום הוצאות החתונה, שכן לא פירט התחייבויות ספציפיות כלשהן ולא הציג אסמכתאות. בהעדר תשתית כאמור, לא ניתן להיעתר לבקשה. לכך יש להוסיף כי לאחר עיון בפסק הדין של בית משפט מחוזי מרכז, ובכתב הערעור, לא אוכל לקבוע כי סיכויי ההליך טובים במידה המצדיקה מתן פטור כמבוקש. בשים לב להיקפו של ההליך, לגובה ההוצאות בהן חויב המערער בבית המשפט קמא ולעמדת המשיב, יועמד סכום העירבון בהליך זה על סך של 4,000 ₪. העירבון יופקד תוך 14 יום, ולא – יידחה ההליך, בלא צורך בכל הודעה נוספת.
