החלטה
בפניי ערר על החלטת בית המשפט המחוזי בנצרת בב"ש 643/09 מיום 22.3.2009, לפיה נדחתה בקשתו של העורר לעיון חוזר בהחלטה למעצרו עד תום הליכים המתנהלים כנגדו.
כנגד העורר וכנגד שניים נוספים הוגש לבית המשפט המחוזי בנצרת כתב אישום (פ"ח 42/08), המייחס לו עבירה של ניסיון לרצח, לפי סעיף 305(1) לחוק העונשין, התשל"ז-1977 (להלן: חוק העונשין ); עבירה של חבלה בכוונה מחמירה, לפי סעיף 329(א)(1) לחוק העונשין; עבירה של נשיאה והחזקת נשק, לפי סעיפים 144(א) ו-(ב) לחוק העונשין; ועבירה של תגרה, לפי סעיף 191 לחוק העונשין.
על פי המתואר בכתב האישום, בין משפחתם של העורר והנאשמים האחרים ובין פלג אחר של משפחתם שרר סכסוך עובר לאירוע נשוא כתב האישום. ביום 29.9.2008 פרצה בין שני הפלגים קטטה רבת משתתפים, במהלכה יידו הצדדים אבנים, ובני משפחת העורר אף השתמשו בחומרי נפץ דוגמת רימונים וזיקוקים. במסגרת הקטטה ירה העורר לעבר בני הפלג השני מספר רב של יריות מאקדח, תוך פציעת שניים מהם.
בד בבד עם הגשת כתב האישום, הוגשה ל בית המשפט המחוזי בקשה למעצרו של העורר עד תום ההליכים המשפטיים המתנהלים כנגדו (ב"ש 1843/08). ביום 4.12008 קיבל בית המשפט
המחוזי (כבוד השופט י' אברהם ) את הבקשה לגבי העורר ולגבי נאשם נוסף.
על החלטה זו הגישו העורר והנאשם הנוסף ערר לבית משפט זה (בש"פ 399/09). ביום 11.2.2009 דחה בית משפט זה (כבוד השופט א' גרוניס ) את הערר לגבי העורר, וקיבל אותו לגבי הנאשם הנוסף.
ביום 19.3.2009 הגיש העורר בקשה לבית המשפט המחוזי לעיון חוזר בהחלטה לעוצרו עד תום ההליכים (ב"ש 643/09). העורר תיאר בבקשתו כי בין שני הפלגים נחתם הסכם סולחה, בו התחייבו שני הצדדים לשמור על רגיעה, כשבעקבות הסכם הסולחה הגישו שני המתלוננים בתיק בקשה למשטרה לחזור בהם מתלונותיהם.
ביום 22.3.2009 דחה בית המשפט המחוזי את בקשתו של העורר, בקובעו כי להסדר סולחה לא יכול להיות משקל ממשי במסגרת בקשה לעיון חוזר, בהיעדר שינוי נסיבתי נוסף אחר, במקרה בו מדובר במי שנשקפת ממנו מסוכנות רבה. בית המשפט אף נמנע בהחלטתו מלהורות על עריכתו של תסקיר מטעם שירות המבחן בעניינו של העורר.
מכאן הערר שבפניי.
לטענת בא כוח העורר שגה בית המשפט המחוזי בהחליטו שלא לקבל את הבקשה לעיון חוזר, אף מבלי להורות על עריכתו של תסקיר. לטענתו, מסוכנותו של העורר אינה אינהרנטית, אלא נובעת מהסכסוך בין הפלגים, כך שיש בהסכם הסולחה כדי להקטין בצורה משמעותית את מסוכנותו. עוד מוסיף בא כוח העורר, כי חיזוק מוסד הסולחה הוא אינטרס של כלל רשויות החוק, בהיותו מוסד מסורתי ליישוב סכסוכים, בעל מעמד ציבורי והכרה חברתית במגזר הערבי.
מנגד, סומך בא כוח המשיבה את ידיו על החלטת בית המשפט המחוזי ומבקש לדחות את הערר, בהדגישו כי אין בהסכם הסולחה, לכשעצמו, כדי לשנות מהקביעות בדבר מסוכנותו של העורר ומהכרח למעצרו מאחורי סורג ובריח.
לאחר עיון בהודעת הערר ובהחלטתו של בית המשפט המחוזי, ולאחר ששמעתי את טיעוני הצדדים, הגעתי לכלל מסקנה כי דין הערר להידחות.
בית משפט זה התייחס לא פעם בפסיקתו למוסד הסולחה, ולמקום שיש להעניק לו במסגרת ההליך המשפטי (ראו, למשל, בש"פ 7734/98 אבו ראס נ' מדינת ישראל (לא פורסם, 21.12.1998); בש"פ 8512/02 נסראלדין נ' מדינת ישראל (לא פורסם, 21.10.2002); בש"פ 8041/06 מרזוק נ' מדינת ישראל (לא פורסם, 31.10.2006); בש"פ 8449/07 אבו ג'ודה נ' מדינת ישראל (לא פורסם, 16.10.2007); בש"פ 590/08 מדינת ישראל נ' מריסאת (לא פורסם, 21.1.2008)). בפסיקה זו הכיר בית המשפט בחשיבותו של מוסד זה בחברות מסורתיות, בהשכינו לא פעם שלום בית בין קבוצות יריבות, בתיווכם של נכבדי העדה, תוך קידום עקרונות של "צדק מאחה", אשר יש בהם לא פעם כדי להביא לסיומם סכסוכים אלימים. אציין כי אף אני שותף לגישה זו, המשלימה את פועלו של המשפט הפוראמלי, באמצעות הידברות ומפגש בין הצדדים לסכסוך, ומתן גושפנקא להסכם זה מידי דמויות סמכויותיות.
אלא שיש לזכור, כי חרף חשיבותו של מוסד הסולחה כאמצעי לפתרון סכסוכים, מדובר במוסד שמעצם מהותו הינו חיצוני ומקביל להליך העונשי, ועל כן השלכתו על ההליכים המשפטיים לא תהיה ישירה, ומידת השפעתו תשתנה ממקרה למקרה. על פי רוב, עיקר המשקל המוענק להסכם הסולחה יהיה רק לקראת מיצוי ההליך המשפטי – בשלב גזירת הדין, כחלק ממכלול השיקולים הנשקלים לקולת העונש, או במסגרת הטעמים לקבלתו של הסדר טיעון (ראו, למשל, ע"פ 7126/04 גדיד נ' מדינת ישראל (לא פורסם, 27.6.2005); והשוו רון שפירא, הגיעה העת לסולחה", הפרקליט מח(2) 433, 438 (2006)).
במקביל, ניתן להתייחס להסכם הסולחה גם בסוגיות הנוגעות למעצר, כחלק מהערכת מסוכנותו של הנאשם. אלא שגם כאן הסכם הסולחה אינו חזות הכול, אלא אך רכיב אחד בשאלה העובדתית בדבר המסוכנות. כך, יהיו מקרים שנסיבותיהם יצדיקו מתן משקל מכריע לפיוס בין הצדדים, ומנגד מקרים בהם משקלו של הסכם זה יהא מועט ביותר – כל מקרה ונסיבותיו. עם זאת, ככלל ניתן לומר כי לרוב אין בהסכם הסולחה כדי לשמש ערובה מפני הישנותם של מעשי אלימות בין הצדדים לסכסוך שברקע הסכם, ואין בו עצמו כדי לאיין את מסוכנותו של מי שמואשם בביצוע עבירות על רקע סכסוך זה (ראו בש"פ 10495/03 חוסייני נ' מדינת ישראל (לא פורסם, 9.12.2003)).
בענייננו, לא מצאתי כי יש בהסכם הסולחה כדי לשנות מההחלטה בדבר מעצרו של העורר עד תום ההליכים. מדובר במי שקיימות כנגדו ראיות לכאורה בדבר ביצוען של עבירות אלימות קשות ביותר, תוך ניסיון לפגוע בחייהם של הניצבים מולו וגרימת חבלות קשות לשניים מהם, באמצעות ירי רב ונמשך מאקדח. זאת, יחד עם עברו הפלילי, הכולל מספר הרשעות ובהן בעבירות אלימות, מביאים למסקנה חד משמעית בדבר מסוכנות שלא ניתן להפיגה באמצעות חלופת מעצר, ואין בחתימת הסכם הסולחה, בנסיבות המקרה הנדון, כדי לשנות מקביעה זו.
סוף דבר, החלטתו של בית המשפט המחוזי מנומקת ומבוססת ולא מצאתי מקום להתערב בה.
על יסוד כל האמור לעיל, הערר נדחה.
