בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון או לחלופין – להפחתת סכום העירבון. הבקשה הוגשה במסגרת בקשת רשות ערעור על החלטה של בית המשפט המחוזי בירושלים, אשר דחה את בקשתם של המבקשים למתן רשות ערעור על החלטה של בית משפט השלום, אשר דחה את טענתם של המבקשים בדבר חוסר סמכותו לדון בתביעה שהגישה המשיבה.
עיינתי בטענות הצדדים ולא ראיתי ליתן פטור כמבוקש.
ראשית אציין, כי בבית המשפט המחוזי הפקידו המבקשים עירבון בסך של 10,000 ₪ (הם גם שילמו אגרה בהליך שבכותרת, וכן בתביעה שהגישו בבית הדין לעבודה – כך לטענת המשיבה). עובדה זו מצביעה על יכולת לגייס סכום-כסף לצורך עירבון, ואציין כי המבקשים חויבו בבית המשפט המחוזי בהוצאות בסך 5,000 ₪, כך שיש להניח כי היתרה הוחזרה לידיהם (ראו הוראת בית המשפט בסיפא לפסק-דינו). זאת ועוד, מצויים אנו היום בשלב של "גלגול שלישי", שבו המשֹוכה גבוהה יותר, וממילא הצורך בהפקדת עירבון הולם מקבל משנה-תוקף.
לגבי המצב הכלכלי אוסיף, כי המבקשים לא הוכיחו כדבעי כי אינם יכולים להפקיד עירבון. כך למשל, לא הובאו מסמכים לגבי ההוצאות הנטענות, ולא הוצגו פירוט ותיעוד באשר לאפשרות להסתייע בסביבה הקרובה (ראו בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב (3.10.2011); בש"א 9998/09 ונדר נ' בנק דיסקונט למשכנתאות בע"מ (17.12.2009)). למעשה, לבקשה צורפו מסמכים מעטים וחלקיים – תלוש משכורת בודד לכל אחד מן המערערים, ודף חשבון בנק המתייחס לתקופה קצרה. ברי כי בכך לא סגי לשם הצגת התמונה המלאה.
