בקשה לעיון בתיק
החלטה
לפניי בקשה לעיון בתיק שבכותרת.
בבקשה נטען כי מבקש העיון מנהל הליכים משפטיים נגד חברת 012 סמייל טלקום בע"מ, העוסקים בין היתר בשאלת זהותה של החברה וקשריה עם חברות אחרות, וכי במסגרת ההליך שבכותרת הוגשו בקשות הנוגעות לשאלה זו. המבקשת בהליך (012 סמייל טלקום בע"מ; להלן: 012 ) מתנגדת לעיון, בטענה כי נימוקיו של מבקש העיון כלליים ומעורפלים; כי המבקש אינו מקיים הליכים נגד 012 (אם כי בעבר הגיש נגד 012 בקשה לאישור תובענה ייצוגית, שנדחתה); כי למעשה מדובר ב"דיג ראיות פסול"; וכי התיק מכיל סודות מסחריים של 012. כמו כן, בתגובתה של 012 נזכרו בקשות עיון נוספות שהגיש המבקש בתיקים ש-012 צד להם. בהחלטתי מיום 30.4.2014 התבקשה המבקשת להבהיר אם בקשות העיון האחרות נדונו והוכרעו, ואם כן – לצרף את ההחלטות שניתנו בעניין זה. ביום 11.5.2014 הגישה 012 תגובה משלימה, שממנה עולה כי מרבית בקשות העיון שהגיש המבקש התקבלו, וכי בקשה אחת נדחתה בשל אופן ניסוחה ואי-הצגת נימוקים רלוונטיים, תוך שהובהר כי אם תוגש בקשה עניינית שתכלול טיעונים רלוונטיים – היא תידון.
הגישה שהנחתה את הערכאות שדנו בבקשות העיון הנוספות שהגיש המבקש יפה גם לבקשה שלפניי. כידוע, הכלל הבסיסי הוא שבמקום שהעיון אינו אסור על-פי דין – וזה המצב בענייננו – נקודת המוצא היא שיש לאפשר את העיון בתיק, וכי הנטל להצדיק את מניעת העיון מוטל על המתנגד לו. בהקשר זה יודגש כי נטל ההנמקה הרובץ לפתחו של מבקש העיון הוא קל יחסית, זאת לאור מעמדו וחשיבותו של עקרון פומביות הדיון. "נוכח העובדה כי הנטל לשכנע את בית המשפט מוטל על המתנגד לעיון, יכול מבקש העיון להסתפק בהנמקה קצרה ותמציתית שכל תכליתה לבאר לבית משפט מהו האינטרס שלו בעיון, וזאת לצורך איזון אינטרס זה אל מול אינטרסים אחרים..." (בג"ץ 5917/97 האגודה לזכויות האזרח בישראל נ' שר המשפטים , פס' 25 (8.10.2009)). בענייננו, סבורני כי המבקש עמד בנטל זה, וזאת גם אם לא הרחיב כיצד עשוי העיון להועיל לו בהליך משפטי אחֵר (קיים או עתידי).
כאמור, בעל-דין המתנגד לעיון נדרש לעמוד בנטל לשכנע כי אין להתירו. "הכלל הוא אפוא שיש לאפשר עיון במסמכים המצויים בתיקי בית-המשפט, ואף את פרסומם, אלא אם קיימים הוראה תחיקתית או טעם כבד-משקל הנגזר ממנה המצדיקים, באיזון כולל, את מניעת העיון או הפרסום" (ע"א 4825/97 גהל נ' פקיד השומה למפעלים גדולים , פ"ד נה(2) 433, 437 (2000)). לא מצאתי בתגובתה של 012 טעם כבד משקל הגובר על עקרון פומביות הדיון וחופש המידע. כאן המקום להדגיש, כי טענתה של 012 בעניין סודות מסחריים הועלתה בכלליות, ללא הסבר קונקרטי וללא הפנייה למסמכים ספציפיים, למעט ציון כמה חשבוניות (מלפני מספר שנים) "מבלי למצות". אולם, כפי שנפסק לא אחת, וכפי שהודגש גם בהחלטות קודמות בבקשות עיון של המבקש, בטענות כלליות לא סגי: "טענה כללית בדבר סודות מסחריים בין היתר בעניין הסכמי ספק מלפני למעלה מ-4 שנים – כאשר המבקש אינו מתחרה של 012 – אין בה כדי לעמוד בנטל הנדרש ממי שמבקש למנוע את זכות העיון בהליך שהוא במהותו הליך פומבי" (החלטת כבוד השופטת קרת-מאיר מיום 28.11.2013 בתיק 18048-12-09; ראו גם החלטת כבוד השופט קינר מיום 13.2.2014 בתיק 4280-08-07). דברים אלה יפים במישור העקרוני גם לענייננו, ואדגיש כי בחנתי את המסמכים הספציפיים שאליהם הפנתה 012, ולא מצאתי כי הם מקימים הצדקה לשלול את זכות העיון בתיק.
אשר על כן, אני מורה בזאת כדלקמן:

המבקש רשאי לעיין בתיק בתיאום עם מזכירות בית המשפט ובהתאם להנחיותיה.
2.
העיון יעוכב למשך 10 ימים, כך שאם תוגש במסגרת תקופה זו בקשה מנומקת מצד 012 להגביל את העיון במסמך מסוים בשל פגיעה ממשית וקונקרטית באינטרס מוגן (סוד מסחרי) – תובא הבקשה לפניי למתן החלטה.
