בקשה לפטור מעירבון
החלטה

בפניי בקשה לפטור מהפקדת עירבון בהליך שבכותרת שעניינו ערעור על החלטת בית המשפט המחוזי מרכז מיום 27.11.2012, בה נדחתה בקשת המערער להכריז עליו כפושט רגל ובוטל צו הכינוס שניתן בעניינו.
המערער מדגיש בבקשתו כי מצבו הכלכלי בכי רע, כי בשל חובותיו לנושים נפתח הליך פשיטת הרגל בעניינו, וכי על רקע אי יכולתו לעמוד בצו התשלומים המתוקן שנקבע לו בוטלו הליכי פשיטת הרגל. לטענתו בנסיבות אלו אין באפשרותו להפקיד עירבון בשיעור שנקבע על ידי המזכירה הראשית - סך של 15,000 ש"ח.
המשיבים מתנגדים לבקשה. לטענתם גם אם מצבו הכספי של המערער אינו טוב לא הוכח על ידו כי אין באפשרותו להפקיד עירבון בהליך ועוד הם טוענים כי סיכויי הערעור קלושים.

לאחר שעיינתי בנימוקי הצדדים הגעתי לכלל מסקנה כי דין הבקשה להתקבל בחלקה.
ככלל ראוי לנקוט בגישה זהירה וגמישה יחסית לעניין בקשות פטור המוגשות במסגרת הליכי פשיטת רגל, שהרי די בעצם הכניסה להליך פשיטת רגל כדי להעיד על קשיים כלכליים של מבקש הפטור. יחד עם זאת, הפטור אינו ניתן באופן אוטומטי ועל המבקש להציג תשתית עובדתית וראייתית מלאה ועדכנית המלמדת על יכולתו הכלכלית ולהוכיח כי אכן אין באפשרותו לגייס את סכום העירבון (ראו ע"א 6801/12 גרשי נ' כונס הנכסים הרשמי (4.11.2012)).
במקרה דנן דומה כי אין חולק שמצבו הכספי של המערער אינו טוב נוכח חובותיו הכבדים ל-45 נושים. ואולם, כאמור בכך אין די, ולא ניתן להתעלם מן העובדה שהמערער לא הבהיר כיצד הוא נושא בעלויות ייצוגו המשפטי ובנוסף מכך שאין בבקשה כל התייחסות, לא כל שכן פירוט מלא ותיעוד הולם, לעניין האפשרות העומדת למערער להסתייע בסביבתו הקרובה - כגון רעייתו ובניו הבגירים - לשם גיוס כספי העירבון (וזאת בפרט נוכח האמור בתגובת המנהל המיוחד בהקשר זה, וראו: בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב (3.10.2011); בש"א 9998/09 ונדר נ' בנק דיסקונט למשכנתאות בע"מ (17.12.2009)). כן אציין, בזהירות המתבקשת, כי לא שוכנעתי שסיכויי הערעור, כשלעצמם, מצדיקים לפטור את המערער מחובת הפקדת העירבון.
אשר על כן, אין מקום לפטור את המערער באופן מלא מהפקדת עירבון, אך נוכח מצבו הכספי של המערער כאמור ובשים לב להיקפו של ההליך ולעובדה שבית המשפט קמא נמנע מלחייב את המערער בהוצאות, אעמיד את העירבון על שיעור מתון של 4,000 ש"ח.
המערער יפקיד עירבון בשיעור האמור בתוך 14 ימים מעת המצאת החלטה זו, ולא - יירשם ההליך לדחיה ללא הודעה נוספת.
