בקשה לפטור מעירבון
החלטה

לפני בקשה לפטור מהפקדת עירבון. עניינו של ההליך בבקשת רשות ערעור על החלטת בית המשפט המחוזי בתל אביב- יפו (מיום 26.06.07) לפיה נדחתה בקשת המבקש למתן צו מניעה זמני האוסר על המשיבים
לעשות עסקה מכל סוג שהוא, ועם כל גורם שהוא, בדירה נשוא ההליך (להלן: הדירה). המבקש מבקש לפטור אותו מחובת הפקדת עירבון בנימוק כי במסגרת מינויו לכונס נכסים, ובהסתמך על הסכם פשרה שהוגש לו על ידי הצדדים, ציווה ראש ההוצאה לפועל על המשיב 2 להעביר מחצית מתמורת מכירת הדירה על חשבון פירעון חובות המשיב 1 למבקש. לטענת המבקש, המשיבים הצהירו בהתנגדותם להוצאת הצו הזמני כי
בא כוחם קיבל הצעה לרכישת הדירה בסך 200,000$. לפיכך נמצא סך של 100,000$ לו זכאי המבקש, בידי המשיבים, ומתייתר הצורך בהפקדת עירבון נוסף.

המשיבים מתנגדים לבקשה וטוענים כי המ דובר בבקשה להמרת עירבון בהודעת קיזוז, באצטלה של בקשה לפטור מערבון. לטענתם הודעת הקיזוז שנויה במחלוקת שכן הסכם הפשרה בין הצדדים
קובע כי העברת סכום החוב למבקש מותנית בהסכמתו לסילוק כל תביעותיו כנגד המשיב 1. יתרה מכך, לשיטתם, כל עוד נוקט המבקש בהליכים לביטול החלטת ראש ההוצאה לפועל אין הוא זכאי להסתמך עליה לשם קבלת הכספים. עוד נטען כי המבקש אינו מכבד פסקי דין והחלטות שנפסקו כנגדו בעבר ודי
בכך כדי לדחות הבקשה ולחייב את המבקש
בהפקדת עירבון להבטחת הוצאותיהם.

לאחר עיון בבקשה ובתגובה לה באתי למסקנה כי דין הבקשה להידחות. הצדקה להתיר המרת עירבון בערובה נחותה, תקום כאשר המבקש יעמוד בנטל לפרוש לפני בית המשפט תשתית עובדתית שתצדיק העתרות לבקשה. קיימת מחלוקת בין בעלי הדין אשר לאופיו של החוב ואופן פירעונו ולפיכך ספק אם יוכל לשמש ערובה זמינה ויעילה להבטחת הוצאות המשיבים. לא זו אף זו, המבקש מבסס בקשתו על החלטת כונס הנכסים להורות על מכירת הדירה ועל חלוקת התמורה ממכירתה, אולם קיים צו מניעה זמני המורה על עיכוב הליכי הכינוס (כאמור בהחלטת כבוד השופט א' גרוניס מיום 09.07.07) ולמבקש השגות על עצם החלטת כונס הנכסים. בנסיבות אלו, דין הבקשה להדחות. המבקש יפקיד ערבון בסך 15.000 ₪ תוך 15 ימים מעת המצאת החלטה זו. בהעדר הפקדה כאמור יירשם ההליך לדחייה ללא
צורך במתן הודעה נוספת.
