החלטה

בפניי בקשה שהגישה המשיבה 1 להוצאת שלושה מוצגים (מוצגים 11-13) מתיק מוצגי המערערת ולמחיקת פסקאות מעיקרי הטיעון מטעמה.
עיון בתיק מלמד כי אכן וכטענת המשיבה 1 המדובר במוצגים אשר לא הונחו בפני בית המשפט קמא - המסמכים נוצרו לאחר מועד מתן פסק הדין, והמערערת עצמה הגישה בקשה להוספת ראיות ביחס לשלושה מוצגים אלו בציינה כי מדובר ב"ראיות חדשות, אשר נולדו לאחר מתן פסק הדין מוש א הערעור שבכותרת ואף לאחר הגשת הערעור".
הצדק עם המשיבה 1 כי משהמוצגים הנזכרים לא הוצגו בבית המשפט קמא לא רשאית היתה המערערת לצרפם לתיק מוצגיה מבלי שניתנה לה רשות לכך מבית משפט זה וכי לא היתה רשאית להתייחס אליהם במסגרת טיעוניה (ראו: תקנות 437(א) ו-457(א) ל תקנות סדר הדין האזרחי , תשמ"ד-1984); הנחיה 7(ב) להנחיות נשיאת בית-המשפט העליון; ע"א 8320/09
אלחדד נ' שמיר (13.12.2010)). הטענה אותה העלתה המערערת במסגרת עיקרי הטיעון שהגישה, ולפיה יש לאשר את הצגתם של מוצגים 11-13 על מנת שטיעונה "לא יימצא חסר", מקומה במסגרת בקשה להוספת ראיות - כפי שאכן הוגשה על ידה - והמערערת לא היתה רשאית לעקוף את ההוראות הנזכרות במקביל להגשת הבקשה להוספת ראיות. גם בעובדה אותה ציינה המערערת בעיקרי הטיעון שהגישה ולפיה חלק מן המוצגים הוגשו במסגרת הליך הביניים שהתנהל בבית משפט זה אין כדי לשנות מן המסקנה בעניין, שהרי אם נאמר אחרת ניתן יהיה לעקוף את הוראות הדין והפסיקה בנקל על ידי הגשת מסמכים קודם להגשת תיק המוצגים ומכוח זאת לשוב ולהגישם בגדרו.
אשר על כן, ומשטענות המערערת בדבר ההצדקה לצירוף מוצגים 11-13 לתיק מוצגיה נכללו כבר במסגרת עיקרי טיעוניה, מצאתי לנכון לקבל את הבקשה להוצאת המוצגים ולמחיקת פסקאות מעיקרי הטיעון המתייחסים אליהם, מבלי לבקש את תגובתה לבקשה. המערערת תגיש עיקרי טיעון ותיק מוצגים מתוקנים עד ליום 4.7.2013 (ועם הגשתם תשיב מזכירות בית המשפט לידי המערערת את עיקרי הטיעון ותיק המוצגים המצויים כעת בתיק). עיקרי הטיעון מטעם המשיבות יוגשו עד ליום 14.7.2013.
המערערת תישא בהוצאות המשיבה 1 בסך של 1,500 ש"ח.

אשר לבקשתה של המערערת להוספת ראיות - נראה כי מחמת תקלה בקשה זו לא הועברה לטיפול. בבקשה מצוין כי המשיבות 2-3 נתנו הסכמתן לבקשה ואילו המשיבה 1 מתנגדת לה. משכך תגיש המשיבה 1 תגובתה המנומקת לבקשה בתוך שבעה ימים ממועד המצאת החלטה זו לידיה, והבקשה והתגובה תובאנה בפני הרכב השופטים אשר ידון בערעור.
החלטה
זו תומצא לצדדים, ללא דיחוי, באמצעות הפקסימיליה ותתויק בתיקי השופטים.
