בקשה לפטור מעירבון
החלטה
לפניי בקשה לפטור מהפקדת עירבון או לחלופין להפחתתו. אין בידי להיעתר לבקשה. התנאי הבסיסי שנדרש לעמוד בו בעל-דין המבקש פטור מהפקדת עירבון הוא הוכחת חוסר יכולת כלכלית. בעניין זה לא די בטענות בעלמא. יש לצרף תשתית עובדתית מלאה ועדכנית. המבקשת טוענת כי נקלעה בעת האחרונה לקשיים כלכליים, אולם תימוכין מספקים לטענה זו לא מצאתי. המבקשת צירפה את התלונה שהגישה בעניין הצתת שתי משאיות השייכות לה, וכן דף חשבון בנק. הא ותוּ לא. לא צורפו דוחות לגבי מצב החברה – שלדבריה אינה חדלת פירעון – ולא צורפו מסמכים רלבנטיים נוספים. למבקשת, אף-זאת לדבריה, "נכסים רבים ובכלל זה 6 משאיות המשמשות אותה לעבודתה". לא ברור מדוע נכסים אלה לא יכולים לשמש לצורך גיוס כספי העירבון שנועד להבטחת הוצאות הצד שכנגד הנגרר להליך נוסף. אין גם כל מידע, לא כל שכן תיעוד, באשר לאפשרות להסתייע בסביבה הקרובה – כגון הבעלים החתום על התצהיר והמביע נכונות לחתום על "התחייבות אישית" – לצורך גיוס הסכום הדרוש. לכל אלה מתווספת טענת המשיבות כי טרם שולמו להן ההוצאות שנפסקו בהליכים קודמים.
די באמור לעיל כדי להוביל לדחיית הבקשה שלפניי. אשר על כן, העירבון יופקד תוך 14 ימים מעת המצאת החלטה זו. בהיעדר הפקדה יירשם ההליך לדחייה ללא הודעה נוספת. המבקשת תישא בשכר טרחת עורך-הדין של המשיבות בגין ההליך שלפניי, בסכום של 1,500 ₪.
