החלטה
המבקש הועמד לדין בבית המשפט לתעבורה בתל-אביב-יפו בגין שתי עבירות של נהיגה בזמן פסילה, לפי סעיף 67 לפקודת התעבורה [נוסח חדש], התשכ"א-1961 (להלן: פקודת התעבורה ); עבירה של נהיגה בשכרות ותחת השפעת משקאות משכרים, לפי סעיפים 62(3) ו-39א לפקודת התעבורה, יחד עם תקנה 26(2) לתקנות התעבורה, התשכ"א-1961 וסעיף 38(1) לפקודת התעבורה; עבירה של נהיגה בקלות ראש, לפי סעיף 62(2) יחד עם סעיף 38(2) לפקודת התעבורה; שתי עבירות של נהיגה ללא רישיון נהיגה תקף, לפי סעיף 10 לפקודת התעבורה; שתי עבירות של שימוש ברכב ללא פוליסת ביטוח בת תוקף, לפי סעיף 2 לפקודת ביטוח רכב מנועי [נוסח חדש], התש"ל-1970.
על פי המתואר בכתב האישום הראשון (פ"ל 1559/08), ביום 19.5.2008 נשפט המבקש בהיעדרו בבית המשפט לתעבורה בתל-אביב-יפו בתיק 25849/08, ונגזרו עליו, בין היתר, תשעה חודשי פסילת רישיון נהיגה בפועל. ביום 1.7.2008 הפקיד תצהיר במזכירות בית משפט השלום בתל-אביב-יפו כחלופה להפקדת רישיון נהיגה. ביום 26.9.2008 בשעה 04:50 לערך, נהג המבקש ברכב פרטי בצורת "זיג זג" בתל-אביב ונעצר לבדיקה על ידי השוטרים. בדיקה במכשיר "הינשוף" העלתה כי בדמו של המבקש נמצאו 325 מיקרוגרם אלכוהול לליטר אוויר נשוף. בנוסף, המבקש נהג ללא רישיון נהיגה תקף וללא ביטוח כחוק.
על פי המתואר בכתב האישום השני (פ"ל 1562/08), ביום 28.9.2008 נפסל המבקש בנוכחותו מלהחזיק רישיון נהיגה עד להחלטה אחרת בבית המשפט לתעבורה בתל-אביב-יפו בב"ש 2818/08 (כבוד השופטת ד' ורד ), בעקבות האירועים נשוא כתב האישום בפ"ל 1559/08. ביום 1.10.2008 בשעה 14:50 לערך, נהג המבקש בקטנוע בתל-אביב-יפו, מרחוב יפת ועד לביתו ברחוב הלוטוס, כאשר המשטרה דולקת בעקבותיו. בזמן נהיגתו לעיל, נהג המבקש ללא רישיון נהיגה תקף וללא ביטוח כחוק.
ביום 12.10.2008 הרשיע בית המשפט לתעבורה (כבוד השופט ש' איזקסון ) את המבקש בעבירות שיוחסו לו, וזאת על סמך הודאתו בעובדות המצויות בשני כתבי האישום. ביום 23.10.2008 גזר בית המשפט לתעבורה על המבקש 23 ימי מאסר בפועל; עשרה חודשי מאסר על תנאי למשך שלוש שנים, שלא יעבור עבירה של נהיגה בשכרות, עבירה של נהיגה תחת השפעת משקאות משכרים או עבירה של נהיגה בזמן פסילה; 14 חודשי פסילת רישיון בפועל; עשרה חודשי פסילת רישיון על תנאי למשך שלוש שנים שלא יעבור את אחת מן העבירות בהן הורשע או עבירה של סירוב לתת דגימות דם, שתן ונשיפה; קנס בסך 2,500 ש"ח; התחייבות בסך 10,000 שבמשך שלוש שנים לא יעבור עבירה של נהיגה בשכרות, עבירה של נהיגה תחת השפעת משקאות משכרים, עבירה של סירוב לתת דגימות דם, שתן ונשיפה, עבירה של נהיגה בזמן פסילה, עבירה של נהיגה ללא פוליסת ביטוח בת תוקף או עבירה של עבירה של נהיגה ללא רישיון נהיגה. בית המשפט לתעבורה מצא כי על אף הספק הקיים באשר להליך השיקומי אשר המבקש טען שהינו בעיצומו, נראה כי אכן חל שיפור בהתנהגותו בשנתיים האחרונות. לפיכך קבע כי די בעונשים המפורטים לעיל כדי ללמד אותו לקח לעת הזו.
על גזר דינו של בית המשפט לתעבורה ערערה המשיבה לבית המשפט המחוזי בתל-אביב-יפו (ע"פ 70911/08). ביום 9.2.2009 קיבל בית המשפט המחוזי (כבוד השופטת י' אמסטרדם ) את הערעור וקבע את עונשו של המבקש על עשרה חודשי מאסר בפועל, שירוצו במצטבר לעונש המאסר אותו מרצה המבקש זה מכבר; ופסילת רישיון נהיגה בפועל לתקופה של 36 חודשים וזאת באופן מצטבר לכל עונש פסילה אחר. שאר רכיבי גזר דינו של בית המשפט לתעבורה הושארו על כנם. בית המשפט המחוזי דחה את טענת המבקש כי בהפקדתו תצהיר לבית המשפט במקום רישיון נהיגה ביום 1.7.2008, הוטעה על ידי עורך דינו לחשוב כי מותר לו לנהוג מאחר והוגש ערעור על פסילת רשיונו. עוד צוין כי המבקש הורשע בעבירת נהיגה בשכרות, לה נקבע עונש פסילת רישיון לתקופה מינימאלית של 24 חודשים למעט במקרים חריגים, ובעבירת נהיגה בזמן פסילה, עבירה שראוי שהעוברים עליה ישהו מאחורי סורג ובריח. עוד נקבע כי במעשיו הפגין המבקש חוסר מורא וזלזול כלפי החוק והאוכפים אותו. בית המשפט המחוזי הדגיש גם את עברו הפלילי העשיר של המבקש, וכן כי ביצע חלק מהמעשים בזמן שהיה אמור לשהות במעצר בית מלא, על פי החלטת בית המשפט לתעבורה מיום 28.9.2008. לבסוף ציין בית המשפט המחוזי כי לולא ההלכה כי בית המשפט לערעורים אינו ממצה את הדין עם הנאשם, היה מחמיר בעונשו של זה אף יותר.
מכאן בקשת רשות הערעור שלפניי, אשר בגדרה טוען המבקש כי בית המשפט המחוזי סטה מן ההלכה הקובעת כי ערכאת הערעור לא תחרוג באופן מופרז מהעונש אשר השיתה הערכאה הדיונית על נאשם. לדידו, לאור פסק דינו המנומק של בית המשפט קמא, לא היה מקום להגשת ערעור על ידי המשיבה מלכתחילה. עוד טוען המבקש כי זוהי הפעם הראשונה שעבר את העבירות בגין הורשע, ויש להתחשב בכך כי זוהי לו מעידתו הראשונה בעבירות מן הסוג הזה. לבסוף טען שיש להתחשב בכך כי הינו אדם צעיר, בן 21 שנים, אשר גדל בשכונת מצוקה ומבקש כעת לשקם את חייו ולאחרונה אף החליט למסד את חייו ולהתחתן.
מנגד טוענת המשיבה, כי בקשת רשות הערעור איננה מצדיקה דיון בפני ערכאה שלישית שכן אינה מעלה שאלה בעלת חשיבות משפטית כללית, החורגת מדלת אמותיו של תיק זה. לעניין הטענות גופא, טוענת היא כי עצם קיומו של פער בענישה בין הערכאה הדיונית לערכאת הערעור אינו מצדיק מתן רשות ערעור, אלא בנסיבות יוצאות דופן, ולאור חומרת העבירות אותן עבר המבקש ונסיבות ביצוען, התערבותו של בית המשפט המחוזי בגזר דינו מוצדקת והכרחית.
לאחר שעיינתי בבקשה, בתגובה לה ובפסקי הדין של הערכאות שקדמו לי, הגעתי למסקנה כי דין הבקשה להדחות.
עניינו של המבקש כבר נדון בפני שתי ערכאות שונות. ככלל, הלכה היא, כי רשות ערעור לדיון בגלגול שלישי, ניתנת במשורה באותם מקרים חריגים אשר מעוררים שאלה בעלת חשיבות כללית וציבורית החורגת מעניינם הפרטי של בעלי הדין. במקרה שבפניי, חרף טענות המבקש, הבקשה אינה מעוררת כל שאלה משפטית עקרונית, אשר תצדיק דיון בגלגול שלישי (ראו ר"ע 103/82 חניון חיפה בע"מ נ' מצת אור (הדר חיפה) בע"מ , פ"ד לו (3) 123(1982)).
יתרה מכן, הלכה היא כי טענות בנוגע לחומרת העונש כשלעצמה אינן מקימות עילה למתן רשות ערעור בפני בית משפט זה, אלא בנסיבות של סטייה ניכרת ממדיניות הענישה (ראו רע"פ 1174/97 רפאלי נ' מדינת ישראל (לא פורסם, 24.3.1997); רע"פ 7201/97 בשירי נ' היועץ המשפטי לממשלה (לא פורסם, 11.12.1997)). בנסיבות המקרה, לא מצאתי כל סטייה שכזו מנורמת הענישה המקובלת בעבירות אותן ביצע המבקש. מסיבות אלו בלבד, דין הבקשה להידחות.
אף לגופו של עניין דין הבקשה להידחות. במקום אחר עמדתי על כך כי:
"אמנם ככלל, מן הראוי שהעונש המוטל על ידי ערכאת הערעור לא יחרוג באופן מופרז מזה שהוטל על ידי הערכאה הדיונית מטעמי הוגנות כלפי המערער, אולם עיקרון זה ראוי לאיזון אל מול שיקולים ואינטרסים אחרים העומדים בבסיס הענישה הפלילית, ובעיקר העיקרון לפיו על העונש להלום את המעשה בגינו הוא מוטל ולהתאים להנחיות ההלכה הפסוקה בדבר רמת הענישה הראויה (רע"פ 6163/07 חדורה נ' מדינת ישראל
(טרם פורסם, 22.5.2008))." (ראו רע"פ 225/09 סרסור נ' מדינת ישראל
(לא פורסם, 23.3.2009) (להלן: פרשת סרסור )).
ואכן הצדק היה עם בית המשפט המחוזי אשר החמיר בעונשו של המבקש לאור חומרת מעשיו אשר עולה מעובדות כתבי האישום בהם הורשע. בית משפט זה עמד לא פעם ולא פעמיים על חומרתה הרבה של עבירת הנהיגה בשכרות, וכן על כך כי חריגה מעונש המינימום הקבוע בחוק למבצע עבירה זו, ראוי לה שתעשה במשורה (רע"פ 6439/06 עובדיה קריטי נ' מדינת ישראל (לא פורסם, 19.10.2006); רע"פ 8387/06 אלייא נ' מדינת ישראל (לא פורסם, 1.11.2006); רע"פ 10738/08 כרמון נ' מדינת ישראל (לא פורסם, 28.12.2008); רע"פ 530/09 אסייג נ' מדינת ישראל (לא פורסם, 1.2.2009)). במקרה שלפניי, לא הראה המבקש כל נסיבה יוצאת דופן המצדיקה סטייה מתקופת הפסילה המינימאלית הקבועה בחוק, ועמד על כך בית המשפט המחוזי כי בארבע שנות נהיגתו בכביש, הספיק לצבור 25 הרשעות קודמות בעבירות תעבורה שונות.
נוסף על כך, המבקש הורשע בשתי עבירות של נהיגה בזמן פסילת רישיונו. נהיגה ברכב לאחר ש בית המשפט מצא כי אינו כשיר לנהוג מהווה, ראשית כל, סכנה לציבור הנהגים והולכי הרגל בישראל, אך יתרה מזו מבטאת זלזול בחוק ובבתי המשפט (רע"פ 3878/05 בנגוזי נ' מדינת ישראל (לא פורסם, 26.5.2005); פרשת סרסור ). בנסיבות אלו, לא מצאתי כל עילה להתערב בפסק דינו של בית המשפט המחוזי.
אשר על כן, בקשת רשות הערעור נדחית.
