לפניי בקשה להארכת מועד להגשת ערעור על פסק דינו של בית המשפט המחוזי בירושלים (כב' השופט נ' סולברג) בתביעת דיבה שהגיש המשיב נגד המבקשות. בפסק הדין, המשתרע על 132 עמודים, נותחו בהרחבה יסודות האחריות וההגנות השונות לפי חוק איסור לשון הרע, התשכ"ה-1965 וישומן על מצב דברים של תכנית תחקיר טלוויזיונית. בית המשפט מצא כי בכתבת התחקיר ישנם דברי לשון הרע על המשיב, כי לא עומדות למבקשות ההגנה של אמת בפרסום והגנת תום הלב וכי יש להעמיד את סכום הפיצוי על 300,000 ₪.

פסק הדין ניתן ביום 7.12.2009 שלא במעמד בעלי הדין. הוא הומצא למבקשות למחרת, ביום 8.12.2009. ביום 14.1.2010 הגישו המבקשות, באמצעות בא-כוחן הקודם, בקשה מוסכמת להארכת מועד הדדית להגשת ערעורים עד ליום 31.1.2010. בהחלטתי מיום 18.1.2010 הוארך המועד כמבוקש. ביום 20.1.2010 הגישו המבקשות בקשה נוספת להארכת מועד. הארכה המתבקשת כעת הינה עד ליום 28.2.2010. בקשה זו אינה מוסכמת על המשיב.

לטענת המבקשות, הן זקוקות לארכה נוספת בשל מורכבותו יוצאת הדופן של התיק ובשל החלפת ייצוגן המשפטי של המבקשות ביום 17.1.2010. המבקשות מציינות כי היקף החומר שהצטבר במסגרת הדיון בערכאה הדיונית, הדורש למידה והתייחסות במסגרת הערעור, הינו עצום. הוא כולל אלפי עמודים של כתבי בי-דין, למעלה מ- 1600 עמודי פרוטוקול, 11 תצהירים, שלוש חוות דעת מומחים, חומר רב מהדיון בעניינו של המשיב בבית הדין הצבאי ומסמכים רבים נוספים. המבקשות מוסיפות ומציינות כי עורכי הדין שקיבלו את הייצוג ביום 17.1.2010 לא היו מעורבים בייצוג בתיק במסגרת הערכאה הדיונית ומטבע הדברים יידרש להם זמן לא מבוטל כדי ללמור את החומר וכדי לגבש ולערוך את כתב הערעור. נטען כי החלפת הייצוג, גם אם אין בה כשלעצמה כדי להצדיק הארכת מועד, יש בה כדי לחזק את ההצדקה למתן ארכה כאמור, מקום בו מדובר בסוגיות מורכבות וכאשר הבקשה הוגשה בתוך המועד להגשת הערעור. לבסוף מדגישות המבקשות את חשיבותו של פסק הדין, הן מהפן הציבורי, בשל הסוגיות העקרוניות הנדונות במסגרתו, והן מהפן הפרטי של המבקשות, בשל הפגיעה במוניטין שלהם ובשמן הטוב.

המשיב, המתנגד לבקשה, טוען כי ההסכמה לבקשת הארכה הראשונה ניתנה מטעמים קולגיאליים בלבד, שהתמקדו בעומס אישי על צוות הפרקליטים הקודם של המבקשות. לדברי המשיב, נמסר לו כי אלה שוקדים במרץ על כתיבת הערעור ולא הועלה בפניו, ולו ברמז, דבר הכוונה להחליף את הייצוג. לטענת המשיב, יש למחוק את הבקשה על הסף מחמת העדר תצהיר ומחמת חוסר נקיון כפיים. המשיב סבור כי היה על המבקשות ליתן פירוט, בתצהיר, של נסיבות החלפת הייצוג, לנוכח התנהלות המבקשות בקשר עם הבקשה הראשונה. לטענתו, המבקשות המתינו עם החלפת הייצוג הפורמלית ממש עד לתום התקופה המקורית להגשת ערעור, מתוך מחשבה שיקל עליהן לקבל הארכת מועד נוספת אם יבקשו אותה כעת, כמעמידות את בית המשפט בפני עובדה מוגמרת. המשיב מציין כי מיד לאחר מתן פסק הדין בבית המשפט המחוזי פרסמו המבקשות תגובה בתקשורת, בה מסרו כי יערערו עליו בימים הקרובים לבית המשפט העליון ואף חזרו ופגעו בשמו הטוב של המשיב. אשר למורכבות התיק, טוען המשיב כי אין בפסק הדין שום קביעה עקרונית הסוטה כמלוא הנימה מפסיקה קודמת, מה גם שעסקינן בהכנת ערעור בלבד ולא בכתיבת סיכומים. לבסוף טוען המשיב כי לנוכח מכלול התנהלותן של המבקשות, כל יום שעובר בלא הכרעה חלוטה מחמיר את הנזק הנגרם לו.

לאחר עיון בעמדות הצדדים ובחומר המצוי בתיק, באתי לכלל מסקנה כי יש להיעתר לבקשה בחלקה. הבקשה הוגשה בתוך המועד החוקי שעמד לרשות המבקשות להגשת הערעור. היא הוגשה ביום 20.1.2010 כאשר מניין ארבעים-וחמישה הימים הקבוע בחוק הסתיים ביום 24.1.2010, מועד שאף הוארך בהחלטה עד ליום 31.1.2010. במצב זה, לא התגבשה אצל המשיב הסתמכות על כך שלא יוטרד בהליכי ערעור. למשיב אין כל ציפיות לסופיות ההליכים, מה גם שהוא עצמו הגיש ערעור על פסק הדין (ע"א 751/10 שהוגש ביום 31.1.2010). לעובדה זו חשיבות רבה, שכן עיקרה של הדרישה לטעמים מיוחדים להארכת מועד לנקיטה בהליך משפטי חדש טמון בהגנה על ציפייתו של בעל הדין שכנגד סופיות ההליכים. על רקע זה אף נפסק לא פעם כי בנסיבות של קיום הליך "תלוי ועומד" באותו עניין, הדרישה לקיומו של "טעם מיוחד" היא מרוככת (ראו, בש"א 2124/03 דולב חברה לביטוח בע"מ נ' כהן (לא פורסם, 19.3.2003); ע"א 7044/93 גורה נ' גורה (לא פורסם, 13.12.1994)). יוער, כי למעשה המבקשות כלל אינן נדרשות להצביע על "טעמים מיוחדים" שכן מדובר במועד שקבע רשם לעשיית דבר שבסדר דין ולא במועד שנקבע בחיקוק (ראו, תקנה 528 לתקנות סדר הדין האזרחי, התשמ"ד-1984).

מכל מקום, בנסיבות המקרה שלפניי, מורכבות העניין, מבחינה עובדתית ומשפטית, והיקף ההתדיינות, מבססים "טעם מיוחד" להארכה קצרה של המועד להגשת הערעור. אמנם על פי רוב, פרק הזמן הקבוע בדין להגשת הליך אמור להספיק לבעלי הדין, גם כאשר הכנת הערעור דורשת התמודדות עם סוגיות מורכבות. אך במקרה דנן, לאחר עיון בפסק דינו של בית המשפט המחוזי, אין בידי לשלול את טענת המבקשות כי הכנת הערעור מחייבת התמודדות עם חומר רב, הן במישור העובדתי והן במישור המשפטי.

עם זאת, הבקשה שלפניי מנוסחת בצורה כללית ואינה מבהירה די הצורך מדוע זקוקות המבקשות לפרק זמן ארוך יחסית (עד ליום 28.2.2010) כדי להגיש את ההליך. מדובר בארכה של חמישה שבועות מעבר לפרק הזמן הסטטוטורי שעמד לרשותן. בהקשר זה יש לזכור כי חילופי ייצוג כשלעצמם אינם מצדיקים הארכת מועד, מה גם שחילופי הייצוג נערכו עוד ביום 17.1.2009. חילופי ייצוג אינם בבחינת נסיבה חיצונית שאינה בשליטת בעל הדין, המצדיקה פגיעה בזכויות הדיוניות של בעל הדין שכנגד. עוד יוער בהקשר זה כי המבקשות לא סיפקו כל הסבר לחילופי הייצוג ולכך שאלה נערכו למעלה מחודש ימים אחר מתן פסק הדין, בסמוך לתום התקופה להגשת הערעור. לבסוף יצוין כי תכליתו של כתב הערעור היא להעמיד את בעל הדין שכנגד על הנושאים השנויים במחלוקת ובכך להגדיר את היקף ההתדיינות בין הצדדים בפני ערכאת הערעור (ראו, (בש"א 1516/98 מי עמית בע"מ נ' כרומגן שער העמקים (לא פורסם, 4.5.1998)). כתב הערעור, בשונה מן הסיכומים בכתב, אינו אמור להרצות את טענות המערער בכל תג ותג. בהתאם לכך, קובעת תקנה 414 לתקנות סדר הדין האזרחי כי "כתב הערעור יפרט בצורה תמציתית את נימוקי ההתנגדות להחלטה שעליה מערערים, שלא על דרך הוויכוח או הסיפור..." (לאופן יישומה של תקנה זו ראו, ע"א 1501/05 כהן נ' מנהל מס שבח תל אביב (טרם פורסם, 8.5.2005)). לתכלית מצומצמת זו של כתב הערעור הלשכה על היקף הזמן הנדרש לשם הכנתו, גם כאשר עסקינן בפרשה מורכבת וסבוכה.

בשים לב לדברים אלה ולכלל הנסיבות, לא שוכנעתי כי קיימת הצדקה להאריך את המועד למלוא התקופה המבוקשת, תוך גרימת עינוי דין למשיב. איזון בין מכלול השיקולים והאינטרסים מוביל למסקנה כי יש להסתפק בארכה קצרה יותר, עד ליום 15.2.2010.
סיכומו של דבר, המבקשות רשאיות להגיש את ערעורן עד ליום 15.2.2010. ההחלטה תומצא לבעלי הדין ללא דיחוי באמצעות הפקסימיליה. ככל שיוגש הערעור, תצורף אליו ההחלטה ותתויק בתיק אב"ד בערעור.
