בקשה למתן ערובה אחרת
החלטה

בתיק זה הוגשה בקשה להמרת העירבון בהתחייבות מטעם המערערים ובערבות צד שלישי, או לחלופין – להפחתת סכום העירבון ל- 10,000 ₪. כבוד הרשמת בנמלך הורתה על הגשת תגובת המשיבים לבקשה "וכן לבקשה המשתמעת להפקדת הודעת קיזוז חלף עירבון". המשיב 1 הגיש תגובתו ובה הוא מתנגד לבקשה על כל רכיביה. לאחרונה, על רקע חילופי גברי בלשכת הרשמים, הועברה הבקשה לטיפולי.
איני רואה לחזור ולפרט את הרקע וההליכים הקודמים – ראו לעניין זה החלטתו של כבוד השופט שהם מיום 28.5.2014 בבקשה לעיכוב ביצוע. אתייחס להלן לנושאים הרלוונטיים לעניין העירבון, כפי שעלו מטענות הצדדים:

המערערים מציעים בין היתר להפקיד "התחייבות עצמית". דא עקא, ש"התחייבות עצמית" כלל אינה נחשבת חלופת עירבון לצורך תקנה 429 לתקנות סדר הדין האזרחי, התשמ"ד-1984, והאפשרות להסתפק בהתחייבות כזו מתייחדת למקרים יוצאי-דופן ביותר, כגון כשמדובר בבנק או בחברת ביטוח (ראו בש"א 5385/09 עיריית חיפה נ' עמותת העדה היהודית הספרדית בחיפה
(16.7.2009)). לא זה המקרה שלפנינו.

המערערים מציעים גם "ערבות צד ג". אולם, ערבות צד שלישי היא בטוחה פחותת-ערך בהשוואה לעירבון במזומן או בערבות בנקאית, ולכן התנאים להמרת העירבון בבטוחה כזו דומים לתנאים למתן פטור (מלא או חלקי) מהפקדת עירבון, לאמור: הוכחת חוסר יכולת כלכלית וקיומם של סיכויים טובים להצלחת ההליך. מעבר לכך, כאשר בעל-דין מציע להפקיד ערבות צד ג, מצופה שיציג פרטים רלוונטיים לגבי אותו צד ג. לא זה המקרה שלפנינו.

המערערים מבקשים "במשתמע" להפקיד הודעת קיזוז חלף עירבון. דין הבקשה בעניין זה להידחות, ודי שאציין כי מדברי המערערים עצמם עולה ש"הערעור בעצם מוגש כנגד משיב מס' 1... שהינו המשיב העיקרי בתיק...", ואילו החיובים הכספיים שעליהם מבוססת הבקשה המשתמעת לקיזוז הם חיובים של משיבים אחרים . ברי אפוא כי הודעת קיזוז אינה מהווה חלופה ראויה להפקדת עירבון בתיק זה, ועמדתו של המשיב 1 בעניין זה מקובלת עליי.

המערערים גורסים כי מצבם הכלכלי בכי רע. ברם, טענה זו לא הוכחה כדבעי. המערערים הם חמישה אחים. היחיד שהגיש תצהיר הוא המערער 1. התצהיר דל בפרטים ואינו מציג, כלל וכלל, תמונה מלאה, מפורטת ומדויקת לגבי המצב הכלכלי של המערערים ומשפחותיהם (הכנסות, הוצאות, נכסים, מצב חשבונות הבנק וכדומה). יודגש, כי גם האסמכתאות המצורפות לבקשה חלקיות ביותר (מדובר בתלושי משכורת מעטים ובלתי עדכניים של חלק מהמערערים , וצילום תעודות זהות). עוד אוסיף, כי פרט לטענה כללית, לא הוצג פירוט ותיעוד באשר ליכולתם של המערערים להסתייע בסביבה הקרובה לצורך גיוס כספי העירבון (ראו בש"א 6411/11 שני נ' עו"ד חבר, נאמן לנכסי החייב
(3.10.2011); בש"א 9998/09 ונדר נ' בנק דיסקונט למשכנתאות בע"מ
(17.12.2009)). בהקשר אחרון זה אזכיר כי המערערים הציעו להפקיד "ערבות צד ג", אך אין הסבר מיהו אותו צד ג ומדוע שהלה לא יסייע להפקיד עירבון "בדרך המלך". מעבר לכך, המערערים שילמו את האגרה, הם מיוצגים על-ידי עורך-דין (ואין טענה שהייצוג הוא בחינם), והם גם מבקשים לחלופין להפקיד 10,000 ₪, בלי להוכיח שסכום זה ממצה את יכולתם הכספית.

לבסוף, תנאי נוסף למתן פטור (מלא או חלקי) מהפקדת עירבון הוא שסיכויי ההליך להתקבל גבוהים. לא ארחיב בנושא זה, ואפנה רק להחלטתו של כבוד השופט שהם מיום 28.5.2014 (בבקשה לעיכוב ביצוע), שם ציין – בלי לקבוע מסמרות – כי סיכויי הערעור "אינם מבטיחים". אוסיף כי בהחלטת כבוד השופט שהם חויבו המערערים בהוצאות בסך 5,000 ₪, וכן נקבע כי אין הצדקה לעכב את תשלום ההוצאות שנפסקו בבית המשפט המחוזי לטובת המשיב 1 (בסך 35,000 ₪).

לאור כל האמור, הבקשה נדחית. המערערים יפקידו את העירבון שנקבע תוך 21 ימים מעת המצאת החלטה זו (ימי הפגרה במניין), שאם לא כן יירשם ההליך לדחייה ללא הודעה נוספת. המערערים ישאו בשכר טרחת עורך-הדין של המשיב 1, בגין הבקשה שלפניי, בסך של 2,000 ₪.
