החלטה
בבקשה זו מתבקש בית המשפט לקבוע כי לנוכח העובדה שהמשיבה חויבה, על פי פסק דין חלוט של בית משפט השלום בתל אביב-יפו בת"א 87582/00 (להלן – פסק הדין ), לשלם סכום של 53,237 ש"ח למבקשים 1 וסכום של 31,837 ש"ח למבקש 2, יש לעכב כלפיהם את ביצועו של פסק הדין שניתן בבית המשפט המחוזי בירושלים בת"א 2573/00, אף בלא שתבוצע על ידם הפקדה חלקית כפי שנקבע בהחלטת בית משפט זה על עיכוב ביצועו של פסק הדין בת"א 2573/00.
בפסק הדין נקבע כי ביצועו יעוכב עד שהמבקשים יודיעו במסגרת ההליכים שהתקיימו במקביל (הליך בוררות ות"א 2573/00) כי חזרו בהם מתביעתם בכל החלקים העוסקים בנושאים שנדונו בפסק הדין. בתגובתה טוענת המשיבה כי הודעה כזו הוגשה רק ביום 30.11.06 (להלן - ההודעה ), זמן רב לאחר סיום ההליכים בת"א 2573/00, תוך שיהוי ניכר וחוסר תום לב, וכי לאור זאת, הגישה ל בית משפט קמא תגובה להודעה, תוך עתירה לדחייתה. בנסיבות אלה, סבורני כי הערכאה הנכונה לבירור סוגייה דנן היא אכן בית משפט קמא. על כן, לא ראיתי להיעתר לבקשה זו.
הבקשה נדחית.
