החלטה
לפניי בקשה לפי סעיף 62 לחוק סדר הדין הפלילי (סמכויות אכיפה – מעצרים), התשנ"ו-1996 (להלן: חוק המעצרים ), להארכת מעצרו של המשיב 4 בתשעים ימים החל מיום 28.4.2009 או עד למתן פסק דין בתיק פ"ח 1049/07 בעניינו, בבית משפט המחוזי בתל-אביב-יפו, לפי המוקדם.
בעקבות הסכמת המשיבים 1-3 לבקשה, ביום 7.4.2009 החלטתי להאריך את מעצרם בתשעים ימים או עד למתן פסק-דין בתיק פ"ח 1049/07 של בית המשפט המחוזי בתל-אביב-יפו, הכול לפי המוקדם. על כן החלטה זו עניינה בבקשה להארכת מעצרו של המשיב 4 בלבד (להלן: המשיב ).
עניינו של המשיב נידון פעמים רבות בפני בית משפט זה ועל כן לא ראיתי לנכון לפרט את הכתוב בכתב האישום אשר הוגש נגד המשיב לפרטי פרטים (לפירוט עובדות כתב האישום ראו בש"פ 6471/08 מדינת ישראל נ' אבוטבול (לא פורסם, 29.7.2008)). בקצרה ייאמר, כי על פי הנטען בכתב האישום, המשיב היה חבר בארגון פשע אשר פעל החל משנת 2005 ועד למעצרו בסוף חודש מרץ 2007, ובמסגרתו עסק בפעילות פלילית. תפקידו של המשיב במסגרת ארגון הפשע היה לפתוח "חשבונות קש" על שמם של חברי הארגון לצורך ניהול הפעילות הכספית של הארגון וכן פיקוח, יחד עם אחרים, על סחיטת אנשים באיומים. כתב האישום מייחס למשיב עבירה של מנהל בארגון פשיעה, לפי סעיף 2(א)(1) לחוק מאבק בארגוני פשיעה, התשס"ג-2003 (להלן: חוק מאבק בארגוני פשיעה ); שתי עבירות של סחיטה באיומים במסגרת ארגון פשיעה, לפי סעיף 428 לחוק העונשין, התשל"ז-1977, יחד עם סעיף 3 לחוק מאבק בארגוני פשיעה; ושתי עבירות של הלבנת הון במסגרת ארגון פשיעה, לפי סעיף 3(א) לחוק איסור הלבנת הון, התש"ס-2000, יחד עם סעיף 3 לחוק מאבק בארגוני פשיעה.
בד בבד עם הגשת כתב האישום הוגשה לבית משפט המחוזי בתל-אביב-יפו בקשה להורות על מעצרו של המשיב עד תום ההליכים המשפטיים המתנהלים נגדו (ב"ש 91645/07). ביום 8.7.2007 הורה בית המשפט המחוזי (השופט ע' מודריק ) על מעצרו של המשיב עד לתום ההליכים המשפטיים המתנהלים נגדו. המשיב ערער על ההחלטה לבית משפט זה (בש"פ 6249/07). ביום 5.8.2007 דחה בית משפט זה (השופט ע' פוגלמן ) את עררו של המשיב על החלטה זו. ביום 16.1.2008 דחה בית המשפט המחוזי (ב"ש 94247/07) בקשה מאת המשיב לעיון חוזר בהחלטה לעצרו עד תום ההליכים המשפטיים המתנהלים נגדו, משקבע כי לא חל כרסום בראיות לכאורה הקיימות בעניינו.
משעברו תשעה חודשים ומשפטו של המשיב טרם נסתיים, פנתה המבקשת לבית משפט זה לשוב ולהאריך את מעצרו (בש"פ 804/08). ביום 27.2.2008 נענה בית משפט זה (השופטת ע' ארבל ) לבקשה והאריך את מעצרו בתשעים ימים. נוסף על כך, ביום 18.3.2008 דחה בית משפט זה את בקשתו של המשיב לתיקון החלטתו מיום 27.2.2008 עקב טעויות שטען כי נפלו בה.
ביום 27.3.2008 הגיש המשיב בקשה לעיון חוזר במעצרו (ב"ש 90753/08). ביום 8.4.2008 דחה בית המשפט המחוזי (השופט ג' נויטל ) את הבקשה.
משחלפו תשעים ימים, שבה ופנתה המבקשת לבית משפט זה בבקשה לשוב ולהאריך את מעצרו של המשיב (בש"פ 3346/08). ביום 23.6.2008 נענה בית המשפט (השופט ח' מלצר ) לבקשה והאריך את מעצרו בתשעים ימים נוספים. עם זאת, הורה על עריכת תסקיר על ידי שירות המבחן אשר יוגש ל בית המשפט
עד ליום 21.7.2008, בכדי לבחון את אפשרות שחרורו של המשיב בהמשך.
משחלפו אף תשעים ימים אלו, שבה ופנתה המבקשת לבית משפט זה בבקשה להאריך את מעצרו של המשיב בתשעים ימים נוספים (בש"פ 6741/08). ביום 29.7.2008, לאחר ששירות המבחן נמנע מלהמליץ על שחרורו, הורה בית משפט זה (השופט י' דנציגר ) על הארכת מעצרו של המשיב בתשעים ימים נוספים.
בסיום תקופת מעצר זו, שבה ופנתה המבקשת לבית משפט זה בבקשה להאריך את מעצרו של המשיב בתשעים ימים נוספים (בש"פ 8472/08). ביום 27.10.2008 נענה בית משפט זה (השופטת מ' נאור ) לבקשת המשיבה והורה על הארכת מעצרו של המשיב בתשעים ימים נוספים.
בתום תשעים ימים אלו, בהם טרם נסתיים משפטו של המשיב, שבה ופנתה המבקשת בחמישית לבית משפט זה על מנת להאריך את מעצרו בתשעים ימים נוספים (בש"פ 658/09). ביום 11.2.2009 הורה בית המשפט (השופטת א' פרוקצ'יה ) על הארכת מעצרו של המשיב בתשעים ימים נוספים. בהחלטה ציין בית המשפט כי בהינתן מורכבותו והיקפו של התיק, משפטו של המשיב וחבריו האחרים לכתב האישום התנהל עד לאותה העת ביעילות וללא דופי. בית המשפט עמד על כך כי עד ליום 9.7.2008 התקיימו 52 ישיבות, אשר במהלכן הסתיימה פרשת התביעה, והתקיימו 11 דיוני הוכחות במהלכם נשמעה חלק מפרשת ההגנה. עקב רציחתו של עורך הדין יורם חכם, בזמנו בא כוחו של המשיב 1, חל עיכוב של ארבעה חודשים בהמשך שמיעת פרשת ההגנה, אשר חודש ביום 26.10.2008 בקצב של ארבעה דיוני הוכחות, והמשפט קרב לסיומו, עת יוגשו סיכומי המבקשת וחודש לאחריהם סיכומי הנאשמים. על כן לאור שלבו הסופי של המשפט, המסוכנות הנשקפת מצד המשיב, עברו הפלילי העשיר, החשש לשיבוש הליכים מצידו, והיעדר המלצה מצד שירות המבחן לשחררו חלופת המעצר המוצעת, קיבל בית המשפט את בקשת המבקשת והורה על הארכת מעצרו של המשיב בתשעים ימים נוספים.
משחלפו תשעים ימים אלו, שבה ופנתה המבקשת בשישית לבית משפט זה בבקשה לשוב ולהאריך את מעצרו של המשיב, היא הבקשה שלפניי.
הבקשה סוקרת את מהלך הדיונים עד כה, וממנה עולה כי מאז הארכת מעצרו האחרונה של המשיב, הגישה המבקשת את סיכומיה בכתב ביום 22.2.2009. המשיב 4, כמו גם נאשמים נוספים בפרשה, ביקש לדחות את הגשת סיכומיו ליום 7.4.2009, וביום 19.3.2009 נענה בית המשפט
המחוזי לבקשתו. על רקע זה טוען בא כוח המבקשת כי הכרעת הדין בתיק צפויה בקרוב, ולאחריה, אם יורשע המשיב, יינתן גזר דינו בתקופה הקרובה גם כן. לאור סופו הצפוי של המשפט והתנהלותו היעילה עד כה, וכן לאור המסוכנות הנשקפת מצד המשיב – עליה עמד בית משפט בהחלטות השונות שצוינו לעיל – יש, לדידו, להורות על הארכת מעצרו של המשיב.
מנגד, המשיב מתנגד לבקשה. אף כי אינו חולק כי משפטו יסתיים בקרוב, הרי שלטענתו אין לקחת עובדה זו בחשבון כאשר באים לדון בבקשה להארכת מעצר. לדידו, השיקולים העומדים בפני בית המשפט נוגעים למסוכנות הנשקפת מצד המשיב, קיומה של עילת מעצר נגדו וחלוף הזמן מאז החל משפטו. לטענתו, חלוף הזמן הרב מאז נעצר בטרם הרשעתו מוביל למסקנה כי יש לשחררו לעת הזו, ובמיוחד לאור העובדה כי המסוכנות הנשקפת ממנו אינה גבוהה, אף אם קיימת. עוד הוסיף כי לאור סיום דיוני ההוכחות בתיק, עילת מעצר של שיבוש הליכי משפט כבר אינה קיימת בעניינו. על כן גורס הוא, כי יש לדחות את הבקשה להאריך את מעצרו.
לאחר שעיינתי בבקשה ושמעתי את טיעוני הצדדים, הגעתי לכלל מסקנה כי דין הבקשה להתקבל.
הלכה היא שככל שמתמשך ההליך וחולף הזמן שבו מצוי הנאשם במעצר, הולך וגובר משקלן של חזקת חפותו וזכותו לחירות, על פני שיקולים אחרים (ראו, בין היתר, בש"פ 2970/03 מדינת ישראל נ' נסראלדין (לא פורסם, 2.4.2003); בש"פ 1875/06 מדינת ישראל נ' גבועה (לא פורסם, 14.32006); בש"פ 5827/06 מדינת ישראל נ' ליברטי (לא פורסם, 25.7.2006)). עם זאת, ישנם מקרים, שבהם שומה על בית משפט זה לעשות שימוש בסמכותו לפי סעיף 62 לחוק המעצרים ולהאריך את מעצרו של נאשם, מפעם לפעם. השיקולים העיקריים אותם יש לשקול על מנת להכריע בשאלה זו הם, מחד גיסא, קצב התקדמות שמיעת הראיות בתיק ומאידך גיסא, אופייה של העבירה ומידת המסוכנות הנשקפת מן המשיב ( ראו גם בש"פ 926/06 מדינת ישראל נ' מחמיר (לא פורסם, 6.3.2006); בש"פ 1461/07 מדינת ישראל נ' חכמיגרי (לא פורסם, 21.2.2007) ).
במקרה שלפניי, שוכנעתי כי יש מקום להיעתר לבקשה ולהאריך את מעצרו של המשיב בשישים ימים נוספים, וזאת לנוכח המסוכנות הנשקפת מצדו, העולה מנסיבות ביצוע המעשים המיוחסים לו, וסיומו הצפוי של ההליך המשפטי בעניינו. לפי המיוחס לו בכתב האישום, המשיב חבר עם אחרים במסגרת ארגון פשע, אשר פעל בצורה שיטתית במשך מספר שנים. במסגרת זו, פעל לסחיטת אנשי עסקים מהארץ ומחוצה לה על מנת להניעם לשלם לארגון סכומי כסף, וכן כיוון ופיקח על פעילות הארגון אשר נועדה להסוות בדרכים מתוחכמות את מקור הכספים השונים אשר הגיעו אליו בדרכים לא כשרות. זאת עשה, בהיותו משמש בתפקיד מרכזי בארגון במישור הפיננסי, ובהיותו מופקד על תפעול מערך האבטחה בארגון (להרחבה לעניין תפקידו של המשיב במסגרת ארגון הפשע ראו החלטתו של השופט ע' פוגלמן , אשר הוזכרה לעיל, בבש"פ 6249/07 זוארץ נ' מדינת ישראל (לא פורסם, 5.8.2007)). ודוק, מעשים אלו מעידים כשלעצמם על מסוכנות הנשקפת מצדו, קל וחומר כאשר אלו נעשים במסגרת ארגון פשיעה (ראו בש"פ 4275/03 מדינת ישראל נ' קקון (לא פורסם, 22.5.2003)). נוסף על כך, קצת התקדמות משפטו של נאשם מהווה שיקול מרכזי בבוא בית המשפט להחליט על הארכת מעצרו של נאשם. כפי שיש חשיבות לשאלת קיומם של מועדי דיונים עתידיים בתיק פלוני, כך יש לתת את הדעת לסיומו הצפוי של ההליך המשפטי במסגרת תקופת הארכת זמן מבוקשת, על רקע התקדמות ההליכים עד לאותה העת. על כן, לאור המסוכנות הנשקפת מצד המשיב, אשר לא פגה אף לעת הזו מחד, וסיומו הצפוי של משפטו מאידך, הגעתי למסקנה כי יש להיעתר לבקשה.
לאור האמור לעיל, אני מאריך בזה את מעצרו של המשיב בשישים ימים, החל מיום 28.4.2009 או עד למתן פסק דין בתיק פ"ח 1049/07 בבית המשפט המחוזי בחיפה, לפי המוקדם מבין המועדים.
