בקשה לתיקון הודעת הערעור
החלטה
לפניי בקשה מטעם המשיבים להורות על תיקון הודעת הערעור וזאת מן הטעם שאינה עולה בקנה אחד עם דרישת התמציתיות הקבועה בהוראת תקנה 414 לתקנות סדר הדין האזרחי, התשמ"ד-1984 (להלן: התקנות ). אציין כי הבקשה מתייחסת להודעת ערעור מתוקנת שהוגשה ביום 20.3.2013, בהתאם להחלטתי מיום 14.3.2013. המערערים מתנגדים לבקשה הן בשל השיהוי בהגשתה הן בשל שהודעת הערעור – כך לשיטתם – אינה חורגת מן ההיקף המקובל והראוי בנסיבות העניין.
עיינתי בבקשה שלפניי, בתגובת המערערים ובתיק עצמו, ובאתי לכלל מסקנה כי אכן יש להורות על קיצורו של כתב הערעור.
לפי תקנה 414 לתקנות, "כתב הערעור יפרט בצורה תמציתית את נימוקי ההתנגדות להחלטה שעליה מערערים, שלא על דרך הוויכוח או הסיפור, ויציין כל נימוק במספר סידורי". בית המשפט נדרש לא פעם לפרשנותה ולאופן יישומה של תקנה 414 הנ"ל. כך, בע"א 1501/05 כהן נ' מנהל מס שבח תל-אביב (8.5.2005) נפסק כי ככלל, בית-המשפט אינו משמש "עורך-על" של כתבי-הטענות. עם זאת, כך נקבע, יש לאזן בין זכות הטיעון של בעלי-הדין לבין אינטרסים חשובים אחרים ובהם: זכותו של בעל-הדין שכנגד להבין את גדר המחלוקת ואת הטיעונים שמפניהם עליו להתגונן; האינטרס בקיום שוויון דיוני ומהותי בין בעלי-הדין; והאינטרס בדבר ניהולו היעיל של ההליך המשפטי. עוד נפסק, כי אין לקבוע מסמרות בשאלת היקפו הראוי של כתב-הערעור, וכי שאלה זו תוכרע בכל מקרה לפי נסיבותיו הפרטניות.
אציין, כי לצד ההכרה בחשיבותה של זכות הטיעון של בעלי-הדין וב"ריבונותם" על כתבי טענותיהם, הרי שבית משפט זה רואה חשיבות רבה בכך שכתבי הטענות לא יחרגו בהיקפם מן הראוי ומן הדרוש, ויתרמו לניהולו של הליך יעיל וממוקד תוך שמירה על שוויון דיוני בין בעלי-הדין. על רקע זה, קיימת היום הקפדה – אולי אף יותר מבעבר – על קיום הוראת תקנה 414 לתקנות (ראו גם החלטת כבוד הנשיא א' גרוניס ברע"א 615/11 סופר מדיק (מדיק לייט) נ' Anton Hubner
(27.3.2011)).
בענייננו, לא נעלמו מעיני טענותיהם של המערערים באשר לסיבות שהובילו להרחבת היריעה, אולם חוששני כי היריעה הורחבה עד כדי חריגה ניכרת מחובת התמצות. עיון בהודעת הערעור מלמד כי היא מנוסחת בפירוט רב, על-פני 32 עמודים ללא ריווח ניכר בין השורות (אציין כי פסק-הדין של בית המשפט קמא משתרע על כ- 20 עמודים, ולפי צו הסיכומים על הצדדים לפרוס את טענותיהם על פני 15 עמודים ברווח כפול). למעשה, הודעת הערעור מהווה "גרסה מורחבת של סיכומים בכתב", ללא הבחנה מספקת "בין טענה לבין פירוט הטענה; בין השגה ובין הוכחת ההשגה" (עניין
כהן הנ"ל, פס' 9; עוד ראו ע"א 3263/00 מסיעי אריה שאשא בע"מ נ' עיריית חולון (17.9.2000)). עוד יצוין כי כתב הערעור כולל הפניות וציטוטים נרחבים למדי, זאת כאשר הכלל הוא שלרוב "די יהיה בכתב ערעור המשתרע על מספר בודד של עמודים, בלא ציטוטים, הפניות ואסמכתאות" (עניין
כהן הנ"ל, פס' 6 להחלטה, וכן ראו פס' 4 להחלטה). לבסוף יוטעם כי כתב הערעור כולל גם הפניות לנספחים אשר הוסרו מכתב הערעור בהתאם להחלטתי מיום 2.4.2013.
עניין נוסף שראיתי לנכון להתייחס אליו הוא מועד הגשת הבקשה. מקובל עליי כי הבקשה הוגשה בשיהוי מסוים, וכן מקובל עליי כי במקרים מסוימים שיהוי בהקשת בקשה לתיקון הודעת הערעור עשוי להצדיק אי-היענות לה. עם זאת, יש לבחון כל מקרה לפי נסיבותיו ולאור כלל השיקולים הרלוונטיים, לרבות השיקול של יעילות ההליך ומניעת סרבולו. אציין, כי הבקשה שלפניי הוגשה בסמוך לאחר מתן צו הסיכומים, וכמובן לפני המועד שנקבע להגשת סיכומי הצדדים. בסיכומו של דבר, לא מצאתי לנכון לדחות את הבקשה רק משום השיהוי הנטען, עם זאת בנסיבות המקרה סבורני כי אין מקום לפסוק הוצאות בגין הבקשה שלפניי.
ועוד הערה לפני סיום: המשיבים פירטו סעיפים בהודעת הערעור שאותם יש, לשיטתם, למחוק או לתקן. לא ראיתי להורות כך; יש להסתפק במקרה זה בקציבת מכסת עמודים סבירה, ואין מקום להתערבות מעבר לכך בניסוח הודעת הערעור ובבחירת הטיעונים שיועלו במסגרתה.
לאור האמור, אני מורה בזאת על תיקונו של כתב הערעור. המזכירות תחזיר למערערים את הודעות הערעור (הן המקורית הן המתוקנת שהוגשה ביום 20.3.2013), והמערערים יגישו, תוך 7 ימים, הודעת ערעור מתוקנת בהיקף של עד 18 עמודים ברווח כפול. אין צו להוצאות.
