בקשה לתיקון כתב בית-דין
החלטה
לפניי בקשה לתיקון הודעת הערעור.
המשיבים הגישו תביעת נזיקין בגין רשלנות רפואית שיוחסה לד"ר אלברט מנחם ז"ל – רשלנות שבגינה, כך נטען, הוחמר מצבו הרפואי של המשיב 3 הלוקה בפיגור שכלי. המערערים הם ילדיו של ד"ר מנחם ז"ל, אשר צורפו בשנת 2010 כבעלי-דין בהליך בבית המשפט קמא (כיורשים על-פי דין, זאת לאחר שרעיית המנוח, שירשה את עיזבונו, הלכה גם היא לעולמה). אין צורך לתאר כאן את כל השתלשלות העניינים בהליך המשפטי, הכוללת ערעור לבית המשפט העליון (ע"א 8279/02) שבעקבותיו הוחזר הדיון לבית המשפט קמא לצורך הכרעה בעניין היקף הנזק והפיצוי בראשי הנזק השונים. ביום 10.10.2012 נתן בית המשפט המחוזי פסק-דין משלים באשר לנזק, שבו נדונה גם שאלת חבותם של המערערים-היורשים. בסיכומו של דבר, בית המשפט אמד את סכום הפיצוי המתאים וקבע כי על המערערים לשלם את מלוא החוב של אביהם המנוח.
המערערים הגישו את ערעורם ביום 28.11.2012. המשיבים מצדם הגישו ערעור שכנגד ביום 14.1.2013. ביום 3.3.2013 הוגשה הבקשה שלפניי לתיקון הודעת הערעור. בבקשה נטען כי המערערים החליפו את ייצוגם, וכי הם מבקשים עתה לתקן את הודעת הערעור, קרי: להוסיף לה כמה טענות ממוקדות באופן שיאפשר לערכאת הערעור להידרש לכל ההיבטים המשפטיים של המחלוקת. המערערים מדגישים את המועד המוקדם שבו מוגשת הבקשה, ומציינים כי אין בתיקון זה משום פגיעה במשיבים או משום סרבול ההליך. המשיבים בתגובתם מתנגדים לתיקון הודעת הערעור, וטוענים כי מדובר בהמשך להתנהלות דיונית חסרת תום-לב מצד המערערים שנועדה להרחיק את המשיבים מן הפיצוי המגיע להם. בין היתר מציינים המשיבים את חילופי הייצוג התכופים אצל המערערים. המשיבים חולקים גם על עצם הנימוקים שאותם מבקשים המערערים להוסיף לערעורם, וטוענים כי מדובר בהרחבת חזית ו"מקצה שיפורים". לבסוף גורסים המשיבים כי חל שיהוי בהגשת הבקשה.
לאחר העיון מצאתי לנכון להתיר את התיקון המבוקש תוך חיוב המערערים בהוצאות.
על-פי תקנה 417 לתקנות סדר הדין האזרחי, התשמ"ד-1984, כתב הערעור ניתן לתיקון "בכל עת שתיראה לבית המשפט". הסמכות הקבועה בתקנה 417 חלה לא רק על תיקון נימוק קיים, אלא גם על הוספת נימוק להודעת הערעור המקורית, ובלבד שלא מדובר בתוספת החורגת מהעילה ומהעובדות שנפרשו לפני בית משפט קמא (ראו ב"ש 63/86 ממן נ' קעטבי , פ"ד מ(1) 194 (1986)). "סמכות זו אינה מוגבלת לעניינים מסוימים והיא משתרעת על תיקון נימוק קיים, על הוספת נימוק, על תיקון או הוספת פריט סעד או כל תיקון דרוש אחר" – ובלבד שאין בתיקון משום חריגה מן המסגרת שנתחמה בערכאה המבררת, ואין בו כדי להסב לצד שכנגד עינוי-דין או לעכב את הטיפול בערעור (ע"א 7019/97 סופר נ' סופר , פ"ד נג(5) 187, 190 (1999)). עוד נקבע כי במקום שבו הליך הערעור מצוי בשלב מוקדם, לפני הגשת הסיכומים וקיום דיון, הגישה לגבי בקשות לתיקון הודעת הערעור היא ליברלית יחסית, בכפוף כמובן לכך שלא מדובר בפריצת הגבולות הראויים מבחינת הזכויות הדיוניות של הצד שכנגד ומבחינת תקינות ההליך המשפטי (ראו חמי בן-נון וטל חבקין הערעור האזרחי 294-293 (מהדורה שלישית, 2012)).
מן הכלל אל הפרט: לאחר שעיינתי בנימוקים שאותם מבקשים המערערים להוסיף – ויודגש כי מדובר בתוספת של נימוקים מסוימים, ולא בשינויים גורפים – ולאחר שנתתי את דעתי למועד שבו הוגשה הבקשה שלפניי (טרם מתן צו סיכומים בתיק), באתי לכלל מסקנה כי יש להתיר את התיקון המבוקש. אציין כי המשיבים אמנם טוענים להתנהלות דיונית נמשכת מצדם של המערערים המתאפיינת בניסיונות לסרבל ולהשהות את ההליך המשפטי, אולם בלי להיכנס לעובי הקורה באשר לטענה כללית זו, לא מצאתי כי הבקשה המסוימת שלפניי כרוכה בפגיעה ניכרת בזכויות הדיוניות של המשיבים או שהיא עלולה להוביל לעיכוב בבירור הערעור. דומני כי ראוי לאפשר למערערים, בשלב מוקדם יחסית זה, להציג את נימוקיהם הנוספים, וטענות המשיבים כמובן שמורות להם והם יוכלו להעלותן בסיכומים ולפני המותב שידון בתיק.
עם זאת, יש מקום לחיוב המערערים בהוצאות המשיבים שנדרשו לטרוח ולהגיש תגובה לבקשה לתיקון הודעת הערעור.
סוף דבר: המערערים יגישו הודעת ערעור מתוקנת תוך 5 ימים, שתכלול כמובן אך ורק את הנימוקים הנוספים המובאים בבקשה שלפניי. המערערים ישלמו למשיבים הוצאות בגין הבקשה בסך של 3,500 ₪.
